Answered: How can I support my sibling applying for a job search opportunity card?

Dear @Debbie,

Welcome back at Wefugees and thank you for your question. You are actually referring to the "job search opportunity card", right? For this one the applicant must have sufficient financial resources to fund the job search in Germany. During the visa process, the applicant can demonstrate this ability with a blocked bank account (the so-called "Sperrkonto" containing a minimum of €1,091 net per month, amount applicable in 2025) or a declaration of commtitment. With the latter the applicant is being invited by a person in Germany submitting a Declaration of Commitment (Verpflichtungserklärung) to a Foreigners Authority (Ausländerbehörde). This declaration obliges the inviter to guarantee the financial support of the visa applicant during their stay in Germany. However, you must have a fairly high income if you want to make such a declaration of commitment. I would advise extreme caution here, as it is possible that people can get into quite a lot of debt if unforeseen costs arise.

At "Make it in Germany" you will find all the requirements for the job search opportunity card and interested people can also take a test there to see whether they fulfil the requirements.

I hope this helps and please don't hesitate to get back to us with any further questions.

All the best,

Answered: Need Advice on My Apprenticeship Application Process and Company Behavior (Asylum Seeker in Germany)

Hi friend, I am doing an Ausbildung and so is a lot of people I know in Hamburg.

Firstly: The Ausländerbehörde will not give you an Ausbildung Approval without the Ausbildung contract. They don’t want word of mouth, they want the contract. They **** at several things before giving you the permission. So it will take you nowhere if you don’t have a contract.

Secondly: I don’t know how it works in Bayern, but it might be very hard for the Behörde to approve your Ausbildung because of how far it is from your home. And if they do give it to you, it will be another difficult process to apply for the right to move out of Bayern for an Ausbildung. Please consider all these things and I’m in no way saying it’s not possible. But if you can find an Ausbildung in Bayern or surrounding areas that will work better in your favour.

thirdly: that company doesn’t seem supportive. Sometimes the Behörde can be difficult and it would be nice to have a company that has your back but this your company seems like they won’t have your back.

Answered: Entgeltumwandlung

Dear @Nevv,

Welcome back at Wefugees and thank you for your question.

Unfortunately, I don't know much about the subject either, but I have tried to do a little research. If I understand you correctly, by ‘Entgeltumwandlung’ you mean a form of company pension scheme. This involves paying part of your gross salary into a pension scheme or similar. In Germany, there are several regulations on when and under what conditions the saved capital can be paid out. Usually, the money from ‘Entgeltumwandlung’ cannot be paid out after a short period of time. If I understand correctly, the payout normally only takes place at retirement age.

Maybe other community members can correct me, if needed or add information.

I hope this helps and all the best,

Answered: I would like to move to a different city within the same state. Is it possible with a 104c?

Hi @helios

If you are receiving state benefits from the Jobcenter, then you are not allowed to move. You can only move if you are able to support yourself financially or you find a job in another place that will cover your costs. In that case, you make a written application with the Ausländerbehörde where you are now living. The Ausländerbehörde of the place you wish to move is also involved and so unfortunately this process can take some time. The application is called ‘Antrag auf Aufhebung der Wohnsitzauflage’. Here is a form you can use to do this:

https://***.fluechtlingsrat-lsa.de/wp-content/uploads/2017/01/Wohnsitzauflage.pdf

Please note that although the general rule on 104c is to include an obligation to live in a certain place, each federal state can issue specific instructions on it. To my knowledge, Saxony is the only state that has said that people with 104c should in general not be given this obligation ‘Wohnsitzauflage’. For all other states the rule remains.

Best,

Éanna

Answered: How can I convert tourist to work in Germany? I can enter to Germany with permesso d soggiorno of italia.

Dear @MCA1986,

Welcome to the Wefugees Community and thank you for reaching out to us.

We discussed similar questions already a few times at this platform. As my colleague explained here, for instance:

"If you have permanent EU residency in Italy (this is called ‘soggiornante di lungo period – CE o UE’), you can enter Germany and apply for a residence permit here.

If you have any other type of permit, you have to first get a visa from the German embassy in Italy."

I hope this helps and please don't hesitate to get back to us with any further questions.

Answered: How can by brother come to Germany with a Jobseeker visa?

Dear @Debbie,

Welcome back to the Wefugees Community and thank you for reaching out to us again.

I remember that you raised a very similar question some time ago (in 2022) and I recommended (and I still do) to check the information at "Make it in Germany" on this. However, something has changed in the legislation in this regard - so it is good that you raise this topic again. In June 2024, the German government introduced the so-called "Job Seach Opportunity card" - they are issued for a maximum of one year. The card allows you to search for gainful employment in Germany, i.e. you can seek employment or become self-employed. For its requierements please follow the link mentioned above. Unfortunately, it is still not easy to obtain a respective visa: Important aspects are that you can secure your livelihood and that your qualifications (vocational training/University degree) are officially recognised in Germany. The latter is a process I recommend to initiate as early as possible (as it can take some time). Also being able to prove German language skills can be crucial. Whether your brother can stay in Germany once he obtained the visa but struggles to find a qualified job here is difficult to assess - I think this will depend on many factors. Maybe a visa for vocational training (Ausbildung) is also an option for him?

Where is your brother now? In case he is in Nigeria or in Ethiopia, I can recommend to contact the counsellors of the project "prepared and successful migration to Germany" by the German Diakonie (Baden und Württemberg). Please see their website for more information.

Dear @Hellothere,

Welcome back at Wefugees and thank you for reaching out to us again.

First of all, congratulations to your new job - I hope you will like it!

From your explanations I can not really tell why they want you to be present that day. I am also not too familiar with these kind of procedures. I doubt that this requirement has anything to do with the re-registration regulations (Ummeldung). I think it would be the best to discuss your issue with whoever told you to be present that day and explain them that you actually have to work.

Sorry that I can't say much more about this matter - maybe other community members can add to my answer.

Dear @Dav,

Welcome to the Wefugees Community and thank you for reaching out to us.

Our platform and experts are based in Germany. Therefore we are not too familiar with the immigration rules in other European countries - like the Netherlands. I am afraid that you need to apply for a work visa, though, in order to be allowed to work in the Netherlands. Another option might be the so-called EU Permanent Residence Permit. You find general information on the requirements i.e. at Handbook Germany,

Dear Bee,

Welcome to the Wefugees Community and thank you for your question.

The "Aidshilfe" provides very useful information at their website. They state:

People with HIV can, in principle, work as doctors or nurses without any problems. Limitations only apply when there may be a risk of infection for other people. It's important to make sure that no blood from the doctor or nurse can comes into contact with a patient’s wound. This, however, is already covered by the normal hygiene procedures.

A risk only exists in a very small number of specific surgical procedures that carry an increased risk of injury for the surgeon; for example, when the surgeon's field of vision is limited and the scalpel has to be guided with the finger. In rare cases, similar situations may occur for dentists, gynecologists and nurses.

People with HIV are not allowed to carry out these procedures. This does not mean, however, that they are not allowed to work in the profession."

And the website "Positive Destinations" collects information on travel, visa and immigration topics for people with HIV. See here, for instance, the country profile of Germany which explains that Germany does not have any restrictions on entry or staying for people with HIV.

I hope this helps and please don't hesitate to get back to us with any further questions.

All the best,

No, you cannot have the cake and eat it too.

Many people would abuse the system if they were allowed to come to Germany as refugees and later switch to a work visa so easily. In this case, the authorities are correct. Either you withdraw the case, which could turn out very badly for you, or you remain in the same pipeline where you are now, waiting to be processed.

Dear @Taka,

Welcome at Wefugees and thank you for reaching out to us!

We just answered the very same question here a few days ago (please check it out for additional details) where my colleague explained:

"As long as you apply for the permit 25b before your permit 104c expires, then your status automatically continues until the Ausländerbehörde makes a decision on your application. The paper they issue which confirms this continuing status is called a 'Fiktionsbescheinigung'.
The Fiktionsbescheinigung allows you to continue to work. You do not have to apply for an additional work permit or anything else."

Dear @Collins1506,

Welcome back at Wefugees and thank you for reaching out to us again.

We had a very similar question here before. You may want to check my colleague's answer. For a truck driving license, the "normal" license (class B) is a requirement - you have to make it first (see also the ADAC for further information).

Dear Mohammad,

Welcome to the Wefugee Community and thank you for your question.

A very similar one was asked here before - maybe you want to check it out (even though it is a couple of years old). Our platform is based in Germany and we are not very familiar with visa/immigration regulations in other countries. I recommend to study the Canadian embassy's website or contact them directly. One further note, you will not be eligible for programmes like the UNHCR resettlement programme (as we discussed in this thread), but you should be able to apply for a regular working visa.

All the best for you and please don't hesitate to get back to us (preferably with questions concerning life/regulations/procedures in Germany).

Regards,

Answered: Self employment and moving out of Jobcenter.

Hi @Simi

Yes, I recommend you speak to the Jobcenter about your plans. They will be able to advise you on how best to set up your business and can pay the costs if there are training courses (Weiterbildung) that you need for your business. Importantly, they can also provide extra financial support called ‘Einstiegsgeld’ for up to 24 months. This is why it is important to speak with them before you set up a business.

There are other supports available to people starting a business. This site is a good source of information on this:

https://***.existenzgruendungsportal.de/Navigation/EN/Home/home.html

The registration of your business does not affect your right to receive benefits. What matters is if a person is able to work. If they are, they get help from the Jobcenter. It does not matter whether they wish to do employed or self-employed work.

What will most likely happen is that you will be moved to a different section of the Jobcenter that is responsible for people who are self-employed. Once you start working in that field, there are additional forms you will have to fill out for the Jobcenter. As the income of someone in self-employment is harder to predict than someone on a fixed salary every month, the Jobcenter will grant you benefits on a preliminary basis. After this period, they will then **** at what income you actually had in that period and as a result you may receive an extra payment (if you did not earn as much as they had predicted) or will have to pay some money back (if you earned more than planned).

This Jobcenter provides a good overview of the situation for self-employed people receiving Bürgergeld:

https://***-jobcenter--ge-de.translate.goog/Jobcenter/MSE-Nord/DE/Geldleistungen/Selbststaendigkeit/Selbststaendigkeit-Knoten.html?_x_tr_sl=de&_x_tr_tl=en&_x_tr_hl=en&_x_tr_pto=wapp

Only once you are earning over the basic threshold for Bürgergeld will your benefits stop. At this point if you still need some financial assistance then you can apply for the benefits Kinderzuschlag from the Familienkasse and Wohngeld from the Sozialamt.

Best,

Answered: Apply for work to Ausländerbehörder as a asylum seeker

Hi @Hellothere

The ‚Erklärung zum Beschäftigungsverhältnis‘ is enough for the work permit.

Each Ausländerbehörde works a bit differently. In some places, you can go in person and submit such an application. Others ask you to send it to them. I cannot say for sure what the usual procedure is at your local Ausländerbehörde but generally per email is fine.

Yes, you will receive a written decision called a ‘Bescheid’ on your application to work. They will send this to you by post.

Your employer will take care of your Sozialversicherungsnummer. You will have to tell your employer which health insurance company (Krankenkasse) you would like to join and you will be registered there. The Krankenkasse will then organise you to be issued with a Sozialversicherungsnummer.

The tax number gets sent to you automatically after you are registered living where you are. If you have not received it or no longer have it, you can ask for tax authority to send it to you by using this online form:

https://***.bzst.de/SiteGlobals/Kontaktformulare/DE/Steuerliche_IDNr/Mitteilung_IdNr/mitteilung_IdNr_node.html

You can start working already even without the tax number. For up to three months, your employer can do a preliminary tax deduction on your wages. If your employer has doubts about this or requires more information, you can show them this document about tax number registration from the tax authority:

https://***.bzst.de/SharedDocs/Downloads/DE/IdNr/hinweis_idnr_gefluechtete_deutsch.pdf?__blob=publicationFile&v=3

Answered: Is It Possible to Work While Searching for a New Ausbildung?

Hi @Looney

You have a residence permit/visa in accordance with paragraph 16a of the immigration law (Aufenthaltsgesetz). Section 4 of this paragraph is about what happens if a person does not complete the Ausbildung as planned. Here in English via online translation:

https://***-gesetze--im--internet-de.translate.goog/aufenthg_2004/__16a.html?_x_tr_sl=de&_x_tr_tl=en&_x_tr_hl=en&_x_tr_pto=wapp

If a person can show they were not responsible for having not completed the Ausbildung, the authorities will give them 6 months to find a new Ausbildung. A clear example of this would be if during the Ausbildung the company went bankrupt and closed down. In your case, you should provide a detailed account of the work conditions and how it would be unreasonable to expect you to continue under those conditions. The authorities have discretion then on whether to accept this account.

If they do not accept your explanation, they will cancel your residence permit and give you a deadline to leave the country. You are then ‘ausreisepflichtig’. If a person is obliged to leave the country but finds an Ausbildung, then there are two options available to them:

Ausbildungsduldung. This is a temporary paper which allows you to stay for the duration of the Ausbildung. If you complete the Ausbildung, then you can get a permit as a skilled worker. You cannot work while waiting for approval for an Ausbildungsduldung.

Residence permit 16g: this is a new permit which would allow you to work up to 20 hours a week in addition to doing the Ausbildung. The main additional requirements to get a 16g instead of Ausbildungsduldung is that you have a passport and you are financially self-sufficient. You can, however, get financial Ausbildung support called BAB (Berufsausbildungsbeihilfe) to help with this.

If you feel you may have been treated unfairly in your current Ausbildung or any future workplace, then you can contact the advisory service ‘Gute Arbeit’. They help foreigners in Germany with questions around workers’ rights:

https://arbeitundleben.de/arbeitsfelder/beratungsnetzwerk

With the permit 38a you have to seek approval for every job you wish to do, including a minijob. You are also obliged to inform your current employer about a second job. They cannot, however, prevent you from having a second job except in certain specific cases. This article gives a good overview of what to be aware of when taking up a second job (article in English via online translation):

you need to select an insurance company first like AOK for example. i picked the one that had an office that was closr to me. tell your employer about your decision. i heard some employers do the registiration process for you but if you have never been insured before, you can just go to the health insurance company with your vertrag and say "i want to be insured by you and i am working at this x job", they will help you. just make sure to let your employer about your health insurance company of choice and let them know after you have gone to the insurance company and register

Dear @Petrus,

Thank you for your reply.

A so-called "Fiktionsbescheinigung" is issued to people who are staying in Germany and have applied for the issuance or extension of a residence permit or settlement permit if the immigration authorities cannot or do not want to make a decision straight away.

Legally, a fictitious certificate is valid as much as the residence permit you previously held. If I remember correctly, some German federal states issued "Fiktionsbescheinigungen" to third country nationals who previously have lived in Ukraine and might meet (soon) the requirements for residence permits according to section 16a (vocational training/Ausbildung) or 16b (studying) of the German Residence Act. But I don't have any information on the respevctive procedures until the actual issuing of a residence permit. Holding a residence permit according to 16a, you might be able to switch your "Ausbildung". Please see this thread and Handbook Germany for further details. However, since I am not familiar with your individual case (and neither a lawyer), I highly recommend to consult a migration counselling office for more tailored advice.

I hope this helps and all the best,

Answered: Ausbildung termination without Kündigung or any information

Hi @Tb_24

It is not clear from your question how exactly the Ausbildung ended. You say your employer said he wasn’t certain he would continue the training with you and then you write that you left the company. If he dismissed you from the company, he is obliged to provide you with a dismissal (Kündigung) in writing. If you left the Ausbildung, you are obliged to submit the Kündigung.

Your employer cannot tell or force you to return to your home country. That is a matter for the immigration authorities. He is obliged to inform them about it though. You need to clarify your situation with the immigration office.

If you can show that it was not your fault that you could not continue with the Ausbildung, then you can be given another six months in Germany to **** for a new Ausbildung. The legal basis for this is paragraph 16a, section 4 of the immigration law, here via online translation:

https://***-gesetze--im--internet-de.translate.goog/aufenthg_2004/__16a.html?_x_tr_sl=de&_x_tr_tl=en&_x_tr_hl=en&_x_tr_pto=wapp

Answered: Does Liebhaberei count as Self-Employment?

Hi @maribel999

Liebhaberei does not count as self-employment. That is why it is given a specific name and there are special rules around it regarding tax at the Finanzamt.

The more accurate question is whether what you do is considered Liebhaberei. If it is, then there is no issue. If it is not, then it is self-employment and is not allowed.

The Finanzamt assesses if what a person does is a Liebhaberei or not. The key aspect is what is called ‘Gewinnerzielungsabsicht’. This means an intention to make a profit. The Finanzamt looks at several aspects of a person’s situation, such as what this income is in relation to their main type of income, if the activity is related to their studies or professional background, whether the person is running it like a business or a hobby etc.

An example they give is someone who has a hobby of bee-keeping. They have a different job and this is just a part-time activity for them. The bees produce honey and the person sells the honey. The money goes towards the costs of maintaining the bees and so there is neither the intention to make a profit or an actual profit.

In your case, you are making a profit, even if quite a small one. If you want to be completely sure, then provide the information to the Finanzamt and they will assess it for you.

Here is a good article about this topic in English via online translation:

https://***-vlh-de.translate.goog/wissen-service/steuer-abc/liebhaberei-was-ist-das-und-werden-dafuer-steuern-faellig.html?_x_tr_sl=de&_x_tr_tl=en&_x_tr_hl=en&_x_tr_pto=wapp

First of all, it is not clear to me if you are already in Germany or if you are still in your country of origin and looking for options to move to Germany. If the latter is the case, I can recommend to get a first overview on the different visa types and procedures at "Make it in Germany".

Regarding the adoption, the German law (§1767 Bürgerliches Gesetzbuch/BGB) says:

"An adult may be adopted as a child if the adoption is morally justified; This is particularly to be assumed if a parent-child relationship has already been established between the adopter and the adoptee".

Why do you want to be adopted or what do you expect from it? I found a useful website (it is in German but you may use the translate function) which provides information on this topic.

I hope this helps and please don't hesitate to get back to us to explain about your situation in more detail or if you have any further questions.

All the best,

Answered: Working visa

Hi @bobi

Unlike some other visas, there are not specific language requirements for the working visa 18b. However, the embassy and BFAA have to **** at how plausible a person’s application is. If a person does not speak German but speaks English and has a job offer with an international company where English is the working language, then that person can receive a visa. However, if a person does not speak German and applies with a job offer to work as a German teacher, they will not receive a visa.

For the job of ZFA I could not find any specific requirements as regards language. For some professions it is clearly regulated. Foreign doctors, for example, must have knowledge of general German at B2 level and additional knowledge of medical German at C1 level.

Here you can see a recommendation of the dentistry association in one of the German states that a person starting an Ausbildung as ZFA should have B2 level of German:

https://***-zahnaerzte--sh-de.translate.goog/sprachkompetenz-ausbildung/?_x_tr_sl=de&_x_tr_tl=en&_x_tr_hl=en&_x_tr_pto=wapp

It is therefore a requirement that you can show knowledge of German in order for your visa application to be plausible. The embassy staff can assess an applicant themselves up to level A2 if a person has a clear ability of German at that level and there is no German certification available.

While it is good that your employer has written something, it does not replace an official certification of German ability. In such cases where a test is not immediately available, the guidelines for the embassy are to provide you with a generous amount of time to take the exam and not to reject the application. These guidelines are found in what is called the Visa Handbook of the German foreign office. It is very long document but the pages 541-555 are relevant to proof of German language ability:

https://***.auswaertiges-amt.de/blob/207816/3cbc239c32b04e2af0ee2e28e9a9ec6b/visumhandbuch-data.pdf

The only further step I can think of is to offer to come and speak with the embassy officials in person at the embassy in order to demonstrate your German ability. I would, however, only recommend doing this if you feel comfortable that you have at least an A2 level of German and are able to show this.

Best,

thank you for sharing your question with the Wefugee Community.

If you have not tried a migration counseling/asylum counseling office, you may want to seek the help of one of these offices. They may be able to help you. Sometimes, these offices have a specific contact person in the Landkreis or they know some other ways to reach the employees of Landkreis. These offices are such as, Caritas, Diakonie, AWO, Flüchtingsrat, or DRK/BRK. If these offices also cannot help you in this regard, then you can perhaps seek the help of a lawyer.

Dear @abc123,

Welcome to the Wefugees Community and thank you for reaching out to us.

If I understand correctly, you are currently holding a residence permit according to section 20 of the German Residence Act for "skilled workers seeking job employment" right? This one is usually issued for up to 18 months i.e. after graduating from a German university.

"Make it in Germany" is providing a good overview on the prospects after graduation. They also have a job pool on their "looking for a job page" - you may want to check it out.

Regarding individual counselling, I can recommend to get in touch with a Migration Counselling office (MBE) first. They have a good overview on the local support structures as well and can refer you accordingly.

I hope this helps and I cross my fingers for your job search!

Answered: Can a resident permit under 25b abs.1, be renewed even if you're not working?

Dear @Tessy,

Welcome to the Wefugees Community and thank you for your question.

Handbook Germany summarise the requirements for the residence permit according to section 25b very nicely in various languages. They explain:

"Your livelihood must be secured primarily through your own income. This means, in principle, that you are not allowed to receive any financial support from the state. However, the immigration authorities can waive this requirement if they assume that your livelihood will be secure in the near future."

So it is a bit difficult to give a straightforward answer as the issuing of the residence permit depends on the individual context as well as the respective prognosis for the applicant. It is also possible that the implementation and the practice varies across Germany's Federal States and responsible authorities (some are stricter than other).

I highly recommend you to consult a migration counselling office to get some support if you are facing difficulties with the renewal of your residence permit or you have any doubts. You can use this search engine to find respective organisations in your area.

In any case, please also don't hesitate to get back to us with any further questions.

All the best,

Answered: How can I move to another country?

Hi @Sidra

I’m sorry to read of your negative experience. The rules for moving to another country to work will vary according to each country. As a general rule, you will have to go through a visa process. Your nursing qualification will have to be recognised and you will have to show you have sufficient language skills to work in that country.

As you speak English, you could **** at the UK or Ireland.

In the UK, to work as a nurse you need to be registered with the Nursing & Midwifery Council, here the process is explained:

https://***.nmc.org.uk/registration/joining-the-register/register-nurse-midwife/trained-outside-uk/

If you have a job offer to work in the UK, you can then apply for a UK health care worker visa:

https://***.gov.uk/health-care-worker-visa

In Ireland, the professional registration is with the Nursing and Midwifery Board of Ireland. Here it explains the process of having a foreign nursing qualification recognised to work n Ireland:

https://***.nmbi.ie/Registration/Qualified-outside-the-EU/Application-Process

Once your qualification is recognised and you have a job offer, you can apply for an Irish ‘Critical Skills Emplöoyment Permit’. Registered nurses are on the list of professions that are entitled to this critical skills permit:

https://***.irishimmigration.ie/coming-to-work-in-ireland/what-are-my-work-visa-options/applying-for-a-long-stay-employment-visa/employment-visa/

Answered: How to make appointment for immigration office in bremen

Hi @Derek

I have looked at the website of the immigration office in Bremen but could find no option to make an appointment. You submit an application to them and if your application is approved, they will make an appointment for you to provide your biometric data. You will then at a later date pick up your resident permit.

To be allowed to work here, you must have the residence permit from Italy called ‘soggiornante di lungo period – CE od. UE’. You submit this with your job offer and house registration to the immigration office.

The type of permit you are applying for is according to paragraph 38a of the immigration law. It isn’t that well known and so the website in Bremen did not have information I could find. But the office in Frankfurt provides some detail on it:

https://frankfurt.de/auslaenderangelegenheiten/ich-moechte-einen-antrag-stellen/arbeitnehmer/38a

You cannot start working until a decision is made on your application.

You can ask a lawyer to submit your application for you but it is not necessary and it will not be processed faster.

Hallo @Ny

I assume you have not already had a residence permit for another reason (e.g. work or studies) up until now? If so, the authorities can issue you with a paper called a Fiktionsbescheinigung, with which you can work.

If you have not already had a permit, you can be issued with another type of Fiktionsbescheinigung but will not be allowed to work until a decision is made on your application.

Hi @Coop

You wrote the following: As per auslanderbehörde until he get approval he can start working.

You also write that he has been working for the past three months.

I understand this to mean that he was given approval to work before his application was processed. Is this the case and in what way was this communicated? Was he issued with a paper called a ‘Fiktionsbescheinigung’ with something on it like ‘Beschäftigung gestattet/ erlaubt’?

If so, it would be highly unusual. I am only aware of it applying in the case of Ukrainians applying for temporary protection here and who are given the right to work already when issued with their Fiktionsbescheinigung.

He can only be issued a work permit for qualified work. Does he have a qualification and is the job one that requires a qualification (at least two years Ausbildung training or study) in Germany?

To answer your specific questions:

1. Should he wait till black and white rejection from Auslanderbehörde?
He can wait or withdraw his application. I do not uderstand what is meant by 'his visa will be rejected because he has a work permit'.

2. Incase of rejection can he appl5job seeking visa from Italy embessy?
Yes, he can apply at the embassy. Here is all the information about the documents he needs:

https://italien.diplo.de/it-de/service/visa-aktuell/-/2582732

3. What if he find another job contact which is blue card level.

The job has to be one that requires a qualification. It does not make a difference if it at Blue Card level.

4. Is there any chance for him from Chsncen karte in june. He is having valid Italian work permit. He is learning German too.

He may be entitled to a Chancenkarte if he has enough points. This article gives a good overview of how it works (in English via online translation):

https://***-ra--maibaum-de.translate.goog/chancenkarte/?_x_tr_sl=de&_x_tr_tl=en&_x_tr_hl=en&_x_tr_pto=wapp

Hi @Gentle james

I presume there is some sort of certificate after one year with an overview of your school (Berufsschule) results. The first main exam during the Ausbildung to be KFZ mechanic is the ‘Abschlussprüfung Teil 1’ which has to be done before the end of the second year.

KFZ mechanic is not a regulated profession. In regulated professions, people cannot work unless they have done a specific qualification. For example, you cannot work as a lawyer unless you have studied law. A car manufacturer or garage can employ anyone to be a KFZ mechanic. They will, of course, prefer to take people who have done a KFZ Ausbildung. If someone has experience and completed part of an Ausbildung, then they may manage to get a job in this area. Please be aware, however, that not having an Ausbildung may put certain restrictions on further career progression. As far as I know, to do additional specialised training in the area of KFZ mechanics, then an Ausbildung is a requirement. You may not also have the same entitlements regarding pay as people who have a full KFZ Ausbildung.

If you have further questions on this, then the HWK is the best place to ask. That is the organisation in Germany that regulates the KFZ mechanic Ausbildung. Here you can read more directly on their website:

https://***-handwerk-de.translate.goog/infos-zur-ausbildung/ausbildungsberufe/berufsprofile/kraftfahrzeugmechatronikerin?_x_tr_sl=de&_x_tr_tl=en&_x_tr_hl=en&_x_tr_pto=wapp

Hi @Aslan

It is not clear from your question whether your company is asking you to go on a short-term basis to Germany and then return to Poland or move to Germany long-term.

In the first case, you do not need a work visa. This procedure is called ‘Entsendung’ in German. If a person is living and working legally in one EU country, then they can be sent to work in another EU country without needing a residence permit.

In the second case, you require a work visa from the German embassy. If you come to Germany and apply here, you will be told to go back to Poland and apply with the German embassy there.

Dear @Donna,

Welcome to the Wefugees Community and thank you for reaching out to us.

We discussed very similar questions on this platform before. You may want to check this thread and also my colleague's answer here for more information.

In short, you most probably need to apply for a respective (work) visa first or hold a so-called "EU permanent residence permit" (Daueraufenthalt EU) in order to be allowed to work in another EU country. For more details on the EU permanent residence permit I recommend Handbook Germany's website.

I hope this helps and please don't hesitate to get back to us with any further questions.

If you have applied for asylum in Germany, no you cannot go to work in another European country. With the EU Permanent residence permit or with the German passport you can then work in other EU countries.

Answered: Information Regarding Possibility and Process of Changing Ausbildung Visa to Work Visa or Residency Permit

Hi @Sachin__Rawat

Yes, it is possible to change from an Ausbildung visa to a work visa. The work visa has to be for qualified work, i.e. a job where an Ausbildung or university degree is required. There are exceptions for citizens of the following countries, who are allowed a work visa for any kind of jobs: Andorra, Austrailia, Israel, Japan, Canada, South Korea, Monaco, New Zealand, San Marino, UK, USA.

Different Ausländerbehörde will have different processing times but 4-5 months for a work visa seems quite long for me. If you find a job, try to make the application for a work permit with all the required documents. The Ausländerbehörde ask the Bundesagentur für Arbeit to check the job conditions but this has to be done within two weeks. After that, you and/or your employer should contact the Ausländerbehörde for updates on the application.

Another option, although quite complicated, is to begin working with your current permit. It allows you to work ten hours a week in a job unrelated to the Ausbildung. You can also work more hours than that if permitted to do so by the Ausländerbehörde. You could then apply for the work permit, which means your Ausbildung permit continues to be valid until they make a decision on your application and you can work in this period.

Best,

Hi @Jassica

As I understand it, the Dublin procedure has ended for you and Germany is now responsible for processing your asylum case. You are now in possession of a paper called ‘Aufenthaltsgestattung’ which is renewed every 6 months.

If the jobs that you and your husband are offered will provide enough income to cover your living costs, then you can move. When people are entitled to money from Sozialamt, then they are obliged to live in the area they were assigned to (this should be written in your paper Aufenthaltsgestattung). If you can support yourself by working, then you do not have to stay there.

You need to make a written application to your local immigration authority (Ausländerbehörde). The application is called ‘Antrag auf Aufhebung der Wohnsitzauflage’. An example of the application form for this can be found here:

https://***.fluechtlingsrat-lsa.de/wp-content/uploads/2017/01/Wohnsitzauflage.pdf

Send copies of the job offers along with the application.

Answered: is it possible to change from Aufenthaltstitel 16a ABS.1 to a work permit before finishing the Ausbildung?

Hi @Ahmed313

Yes, it is possible if it is a permit for qualified work. If you **** at the section 16A, Abs. 1 in the German Aufenthaltsgesetz, you can read clearly in which cases it is allowed to change permits:

Während des Aufenthalts nach Satz 1 darf eine Aufenthaltserlaubnis zu einem anderen Aufenthaltszweck nur zum Zweck einer qualifizierten Berufsausbildung, der Ausübung einer Beschäftigung als Fachkraft, der Ausübung einer Beschäftigung mit ausgeprägten berufspraktischen Kenntnissen nach § 19c Absatz 2 oder in Fällen eines gesetzlichen Anspruchs erteilt werden.

The phrase in bold refers to qualified work.

The profession of engineer is one of the ‘regulated’ professions in Germany, like doctor, lawyer, architect. This means that to work as an engineer here, you need to have your qualification recognised. The office responsible is the regional authority of Münster (as you are resident in Bottrop) and here the process is explained (in English via online translation):

https://***-bezreg--muenster-de.translate.goog/de/schule_und_bildung/schulrecht_schulorganisation_abschluesse_sprachen/anerkennung_von_bildungs_und_berufsnachweisen/schutz_der_berufsbezeichnung_ingenieur_in/index.html?_x_tr_sl=de&_x_tr_tl=en&_x_tr_hl=en&_x_tr_pto=wapp

They need to see your original degree as well as your grades during your studies, in addition to other information.

The alternative is to **** for a position where a university degree is required but it is not specifically the job title of engineer. However, if changing to a work permit the Ausländerbehörde may still need to see your original degree.

Best,

Dear @junaidansari91,

Welcome to the Wefugees Community and thank you for your question.

The "Gewerbeschein" is the business license and is needed if you want to open a business/work self-employed. We discussed a very similar one here before. Please follow the link for the respective discussion and my colleague's expert opinion. I am afraid it will be hardly possible or at least very complicated to be self-employed as long as the asylum procedure is still pending. According to Handbook Germany it is not possible at all. However, I am happy to hear that you are allowed to work as an employee in the meantime.

I hope this helps and please don't hesitate to get back to us with any further questions.

All the best,

Meike

Hi @Malcolm

Yes, with that permit he can set up his own business. Here is a useful starting place with information for migrants on setting up a business:
