Answered: Inquiry Regarding Eligibility for Naturalization (Einbürgerung)

At present you are not eligible for naturalization. For this you need five years of legal residency. There was until recently a possibility for faster naturalization after three years (commonly referred to as ‘Turbo-Einbürgerung’) but this has been removed from the law.

The periods spent with the status of Aufenthaltsgestattung, Duldung and Ausbildungsduldung cannot be counted towards these five years as they are not considered full legal residency. The relevant basis for this is paragraph 10 of the naturalization law (Staatsangehörigkeitsgesetz). The first requirement listed there is that it applies to:

“Foreigners who have been legally ordinarily resident in Germany for five years”

There may be some confusion as the rules are different when calculating the required time you needed for permanent residency. For permanent residency, the authorities can at their discretion include the time spent in the asylum procedure, even if the final decision was negative. For naturalization, the time in the asylum procedure is only counted if the person received full recognition as a refugee.

In my view, you will fulfil the eligibility of five years of legal residence in Germany in December 2026. You may have not received your actual first legal permit until February 2022 but the decision was made in December 2021 and I would date your legal residency in Germany from that date.

Ich vermute, es gibt keine zentralen Register für die Arbeitszeiten eines Unternehmens. Die Arbeitszeiten können bei allen Unternehmen unterschiedlich aussehen. Manchmal sind die Arbeitszeiten auch nicht festgelegt für Arbeitnehmer*innen. Das heißt ‚Gleitzeit‘. Bei Gleitzeit muss man meistens an bestimmten Zeiten bei der Arbeit sein, z.B. Montag bis Freitag immer 10 – 13:00. Ansonsten können sie aber selber entscheiden, wie sie ihre Arbeitsstunden leisten. Manche wollen jeden Tag früh anfangen, manche andere arbeiten lieber bis spät nachmittags.

Sie können sich an die Agentur für Arbeit wenden. Die Agentur hat viele statistischen Informationen zum Arbeitsmarkt. Sie beraten auch Menschen wie Sie, die ein Unternehmen gründen möchten. Je nachdem, in welcher Branche Sie ein Unternehmen gründen möchten, könnten vielleicht auch die IHK und/ oder HWK Information zum Arbeitsmarkt geben.

You write that the father’s address in Münster is or was your intended place of residence. You also write that he has not responded to the Ausländerbehörde and is not cooperating with your plan.

Based on the information you provide, in my view you need to change your intended place of residence. The fact that you are still married does not make a difference in this regard. If you do not have someone else you know in Germany that you can at first stay with, then **** for temporary accommodation such as a hostel, hotel, short-term rental.

As part of the visa process, you are asked where in Germany you plan to live. However, there is not a requirement in your case to show that you have somewhere longer-term to stay. The requirement to have suitable accommodation is for other situations, such as a foreign person wishing to join their foreign spouse in Germany. As the parent of German children, this is not a requirement.

The authorities have some discretion on whether to issue the visa as you are moving to Germany with your children rather than joining them in Germany. You can be given a visa but if must be clearly shown that you will no longer have Nigeria as your usual place of residence. You should at least be able to show you have somewhere to stay at first. Otherwise they may have concerns about the children’s welfare, i.e. that you would arrive in Germany without anywhere for your children to stay, in which case the authority in charge of child protection (Jugendamt) would be contacted.

Answered: The rules guiding the Auslandbehörde

Any Ausländerbehörde has discretion on whether to issue a Niederlassungsleruabnis to a person with 25b. This is different, for example, to people who have full refugee recognition from BAMF. Such people have a full entitlement to be issued with one after a certain period of time.

The rule concerning your situation is in paragraph 26, section 4 of the Aufenthaltsgesetz, here in English via online translation:

(4) Furthermore, a foreigner who holds a residence permit under this section may be granted a settlement permit if the conditions set out in Section 9 (2) sentence 1 are met. Section 9 (2) sentences 2 to 6 apply accordingly. In derogation from Section 55 (3) of the Asylum Act, the period of residence during the asylum procedure preceding the granting of the residence permit shall be counted towards the time limit.

The main court ruling I could find about such cases was a decision by the federal administrative court (Bundesverwaltungsgericht) from 2011. It contains two main points:

The time spent in the asylum procedure should be included when calculating the required time for a Niederlassungserlaubnis, even if there was a negative decision and the person was in possession of a Duldung for some time.
The Ausländerbehörde can require the person to have had a residence permit for a certain amount of time when calculating the time periods.

The second point is to prevent a situation where a person could have been in the asylum procedure for 4.5 years, then on a Duldung, then issued with a permit where they can then after 6 months get a Niederlassungslerlaubnis. A specific amount of time is not mentioned but the court makes reference to the guidelines for the Ausländerbehörde in Berlin that states the person must have had a permit for at least three years. I assume the second Ausländerbehörde you applied to is basing its decision on this.

The immigration law (Aufenthaltsgesetz) is the same through Germany. How the law is implemented can vary to a certain degree from one federal state to another, due to guidelines that each state can produce.

I do not fully understand this part of your question:

And had it been that the Auslandbehörde in my former city had decided that I should leave Germany, would the Auslandbehörde in my present city handled such decision differently? Wouldn't they have respected such decision?

In some matters each Ausländerbehörde is obliged to decide a certain way, in other matters there is discretion available to them on how to decide on a particular matter.

The law that regulates the Ausländerbehörde and other government institutions is called Verwaltungsrecht (administrative law). This means a person can file a legal suit called a Klage with the Verwaltungsgericht if they have unsuccessfully appealed a decision of the Ausländerbehörde and wish to pursue it further.

I had to make some reserch myself and found the following information (at asyl.net, I translated them to English):

"Persons with unclear nationality must expect that the foreigners authority will ask them to contact the foreign missions of all eligible countries (whose nationality they may have) and obtain confirmation of their (non-)possession of the respective nationality.
In contrast to the determination of refugee status, there is no set procedure for determining statelessness in Germany. However, the immigration authority (Ausländerbehörde) can determine statelessness in the course of deciding on an application for a travel document for stateless persons. However, the determination of statelessness is linked to the final clarification of the person's identity. This means that persons who wish to be recognised as stateless must request confirmation of their nationality from the diplomatic mission of their (possible) country of origin. If no such confirmation is issued, statelessness is assumed.

If the foreigners authority has established statelessness, a residence permit can be issued on humanitarian grounds (Section 25 (5) AufenthG) if statelessness constitutes a permanent obstacle to deportation."

Thank you for getting back to us again. Some relevant information on the Hardship Commission I shared already in your last question here but I can also recommend to check my answer given in this thread for further details. Here a summary:

The relevant criterion for the Commission's decision as to whether a "hardship case" exists is the degree of integration in Germany and the hardship that renewed uprooting would mean. Factors such as employment, language skills, educational achievements and social ties (e.g. through involvement in clubs or religious communities) often play a role. So it doesn't matter any risks in the country of origin. These must be asserted in the asylum procedure. The Hardship Commission can only deal with cases of people who have already been obliged to leave the country ("vollziehbar ausreisepflichtig")

The "Orientierungskurs" is part of the broader integration course and focuses on providing knowledge about German society, including its legal system, culture, and values.

The "Einbürgerungstest" (exam for the naturalization) contains almost the same questions as the so-called "Leben in Deutschland" exam (which is the most common certificate to prove the required "basic knowledge of the legal and social system and living conditions in Germany"). Therefore, the immigration office should accept this as well. However, I learned about some cases in which the civil servants at the immigration office were persistently asking for the "Leben in Deutschland" test. I recommend to give it a try nevertheless if you can manage to get an appointment for this earlier.

Otherwise you may explain to the immigration office that you can not get any appointment within their deadline (with presenting your booked appointment for the later date) and ask for an extension. In case you face difficulties, I recommend to get support at a migration counselling office.

It is important to first clarify what type of unemployment benefit you might apply for. If you have been working and paying into the social security system (i.e. more than a minijob) for at least 12 of the past 30 months, then you are entitled to the benefit ‘Arbeitslosengeld’. You apply for this with the Agentur für Arbeit. It is important to know that you are obliged to register as job-seeking ‘arbeitssuchend’ with the Agentur für Arbeit within three working days of being informed you are losing your job.

If you receive the benefit Arbeitslosengeld, there is no issue with your residency rights in Germany. The Arbeitslosengeld is an entitlement you have as a result of working and paying into the system.

The situation is somewhat different with the benefit ‘Bürgergeld’ from the Jobcenter. You have the right to receive this benefit but the Jobcenter may inform the immigration office in this case. I cannot say with certainly whether the immigration office would be informed or not. There are some cases where as a rule this takes place. A common example is if a person come to Germany from another EU country and without having worked here, goes to the Jobcenter and applies for Bürgergeld. The Jobcenter will inform the immigration office and the immigration office will contact the person to examine their right to continue to stay in Germany.

Your situation is different. You a not an EU citizen and so the Jobcenter can only share the information with the immigration for certain types of residency, namely work, training (Ausbildung) and studying. You have the permit Aufenthaltsdokument-GB which is a separate type of permit.

Even if the immigration office was made aware that you are no longer financially self-sufficient, it does not mean you automatically lose your residency status. In practice, what generally happens is that the person is given some time to **** for a new job. In this time they can continue to get the support of the Jobcenter. Only if after a final deadline the person cannot show self-sufficiency, could the immigration office then cancel the residency permit and request the person to leave the country. But they also have discretion in assessing each case and so would also take into account the length of time you have been in Germany, that your wife is working, your kids are at Kita etc.

Depending on your financial situation in the event of a job loss, an alternative to the Bürgergeld would be to apply for the benefits Kinderzuschlag (additional child benefit) and Wohngeld (rent support). These benefits, along with your wife’s income, Kindergeld and potentially Arbeitslosengeld for you, could then be enough combined to cover your costs. There is no issue with you receiving Kinderzuschlag and Wohngeld.

I presume you applied for the residence permit paragraph 24, also called temporary protection, when you came to Germany.

Your residence permit does not automatically change when you become a father of a German child. You have to make an application for a residence permit according to paragraph 28, section 1, number 3 of the immigration law (Aufenthaltsgesetz), here in English via online translation:

A person is not granted this residence permit only by being the parent of a German child, they must also have custody. For this reason, you will need to provide both of the documents ‘Recognition of paternity’ (Vaterschaftsanerkennung) and ‘Declaration of shared custody’ (Erklärung über das gemeinsames Sorgerecht) with your application for a residence permit. You get these documents by going with the mother to your local Jugendamt. You do not have to wait for the child to be born, you can do these already.

The immigration office has some discretion in the amount of time they will issue the permit for. In your case, I think it likely they will issue it for one year first as they may want to check your situation again after a year.

The fact that you are working is not relevant to your right to your current residency papers or to your status as the parent of a German child. It is, however, helpful that you are paying into the German social security system if in the future you wish to have permanent residency in Germany.

Ja genau, unter bestimmten Voraussetzungen können sich Personen nun auch nach weniger als 5 Jahren einbürgern lassen. Handbook Germany hat dazu einen sehr übersichtlichen Beitrag veröffentlicht und listet die Kriterien auf:

Wenn Sie „besonders gut integriert“ sind, also z.B. sehr gut Deutsch sprechen (C1) und sich seit vielen Jahren ehrenamtlich engagieren, können Sie sich bereits nach 3 Jahren einbürgern lassen.
Außerdem können Sie auch frühzeitig eingebürgert werden, wenn Sie mit einem deutschen Staatsangehörigen verheiratet sind. Mehr dazu erfahren Sie im Abschnitt „Ich habe einen deutschen Ehepartner. Gelten für mich besondere Regelungen?“
Wenn Sie den Einbürgerungsantrag gleichzeitig mit Ihrer Familie (Ehepartner*in und ggf. Kinder) beantragen, werden die Fristen verkürzt.

Ich habe ein wenig recherchiert und bisher keine abschließende Definition gefunden, was "besonders gut integriert" genau bedeutet oder beinhalten kann. Letztendlich wird jeder Fall individuell von der zuständigen Einbürgerungsbehörde geprüft. Da das neue Gesetz erst vor kurzem in Kraft getreten ist, habe ich noch nicht viel aus der Praxis dazu gehört. Aber wenn du ansonsten auch alle Voraussetzungen erfüllst, könnten deine Chancen gar nicht so schlecht sein. Ich würde an deiner Stelle mal Kontakt mit der zuständigen Behörde aufnehmen. The marriage procedure in Germany is not dependent on a residence permit or a specific kind - even Duldung holders can marry. However, many people struggling with the variety of documents which are usually required. One more question: The person holding a residence permit acc. to 28 is not already married (to a German), right?

Family-reunification visa application - birth certificate date mismatch with all other documents

I am in working in Germany on employment visa. Now I am about to apply for a Family reunion visa for my wife and daughter in Mumbai VFS.

There is mis match in my wife's birth certificate birth date (22.09.1990) and all other documents such as Passport, Aadhar card, school leaving certificate birth date (24.09.1990). it is not possible to correct the date in birth certificate and school leaving certificate.

Kindly suggest the way around.

I don't know if we can take any exception through Lawyers for mismatch dates or it is impossible to do so as the year of birth is matching with documents and we have a difference of 2 days in birth dates.

In India, during the 1990 citizens usually do not take birth certificates seriously and govt used to capture them offline and that create lots of discrepancies in dates.

I really don't know how the embassy will handle this type of case if I submit the birth certificate and what should I need to do so that my wife can get the visa.

Can I get post study work visa when I finish my degree online after arriving in Germany

I enrolled in IU in October 2022 for a one-year online course. Before completing the program, I requested to transfer to an on-campus course, but was informed the course wasn't available on campus. I then requested a course change to a two-year program that would allow me to attend on-campus classes starting in March 2023. After taking additional courses, I again requested to transfer to the campus in July 2023, but was told I didn't qualify due to my academic background. Disappointed, I decided to enroll in another school in Germany starting in October 2023. Upon arriving, I submitted my study progress from the online school and the enrollment for the new school to the Ausländerbehörde (Foreigners' Office), but was granted a residence permit for the course I had been doing online instead. I graduated from the online course on July 19, 2024, and am now unsure whether to submit my graduation documents to the Ausländerbehörde to get a post-study work visa but I am just skeptical because I heard that they may not grant it because the course was online, and I might need to complete my on-campus studies first, which would be stressful. What should I do or is there something I can do legally to make me get the post study work visa, as now studying to complete the on campus is a bit stressful

Unfortunately, I can not share any experience regarding the waiting period for an "Umverteilungsantrag" (application to move to another place) in Lower Saxony (I assume you applied here?). I am afraid that the process may need several months. I hope other communtiy members can share some personal experience with you - even if I believe that it is not always possible to draw conclusions from one case to the next.

Welcome to the Wefugees Community and thank you for your question.

As Simi mentioned, most of the immigration offices are currently understaffed and procedures take way too long. So, waiting for several weeks or even months is unfortunaltey not unusual. However, I would highly encourage you to contact them again to highlight the importance of the extension of your work permit. The immigration office can also record the work permit on your "Duldung" for the time being or they may give you a paper which states that you will receive the residence permit (and you are allowed to work) but still have to wait for the residence card (which still needs to be produced). I recommend to ask a refugee/migration counselling office for support in this.

Yes, you can change from the permit 104c to a permit 28 for family members of German citizens. The 28 refers to the paragraph of the immigration law which covers this (Aufenthaltsgesetz). I am not very familiar with the institutions in that area and my research wasn't very successful either. I recommend you to contact a migration counselling office (here the contact details for the Red Cross Counselling and here for the Diakonie as well as Caritas) - I am sure they can give you tips and detailed information about the local options (and yes, it is possible that a VHS is offering the A2 exam).

However, I also saw that the Goethe Institut is offering an A2 exam, for example in Frankfurt. You could register here. I learned that there is even availability for the exam in August.

If I remember correctly from one of your last posts, you are currently holding a residence permit according to section 104c ("Chancen-Aufenthaltsrecht"), correct? You are right, in order to receive the residence permit according to section 25b after 18 months, you need to prove that you speak German on A2 level (spoken skills, not necessarily writing/reading skills). There are exams, as you mentioned, which test you up to B1 and may certify an A2 level as well - according to your performance. But there should be A2 exams as well. I made a quick research and found some telc exams offered by different organisations/institutions (for example in Bamberg or Aachen).

It is good that you already take care of it since I heard that in some areas it is really difficult to find a place and waiting lists can be long (there are in general not enough language courses and exams - especially after the introduction of the "Chancen-Aufenthaltsrecht"). Maybe you can share your approximate location with us, so we can support you with searching for some options in your area.

Wenn Sie verheiratet sind, kann er einen Aufenthaltstitel als Familienangehöriger beantragen. Ihm wird aber dann gesagt, er muss ausreisen und das richtige Visum erstmal holen. Das muss er machen, egal ob Sie einen unbefristeten Aufenthalt haben oder einen deutschen Pass.

We discussed a so-called "Asylfolgeantrag" here before - please see my colleague's answer in this thread (as far as I know, the 3 months-rule is not valid anymore though).

Handbook Germany says:

"If there is new evidence regarding your persecution or new circumstances occur (e.g. a change of government in your home country), you can apply for asylum again, i.e. you can submit a subsequent asylum application or „Asylfolgeantrag “. You can also hand in a subsequent asylum application if you suffer from a severe war trauma which has remained undetected before, or in case you have a severe illness that is not curable in your country of origin."

I strongly to discuss this with a lawyer or at least with a refugee/migration counselling office. Without plausibility and good preparation, there is hardly a chance to succeed.

There is a hardship commission in (as far as I know) every federal state in Germany. Their composition, mode of operation and requirements slightly vary. Therefore, I recommend to check the specific information regarding the hardship commission in your federal state. In Berlin, for instance, the members of the hardship commission offer counselling hours for potential applicants - please see this paper for contanct details. In Bavaria (Bayern), I recommend to contact a member of the hardship commission directly as well (please see their details here). The Bavarian hardship commission i.e. usually requires (among other criteria) a minimum stay in Germany of 5 years and a good level of integration (proven throgh i.e. good level of German language, work, school/vocational training performance, voluntary work etc.) and urgent personal or humanitarian reasons to stay in Germany. It is important that applicants have exhausted all other possibilities of getting any kind of residence permit and are actually obliged to leave the country at the time of applying.

Unfortunately, the German authorities do not view it the same way unless you are severely bedridden due to illness. If your country also has hospitals and medicine for this treatment, the court will not permit you to stay here. I have personally witnessed several cases like this myself.

Anyway, You can appeal to the higher management court like Verwaltungsgericht, in case of rejection later on Oberverwaltungsgericht.

Also in parallel you can apply to the "Härtefallkommission' of your state. They are the people who makes it possible, in exceptional cases, to issue a residence permit to foreigners who are actually obliged to leave the country.

You do not make it clear where you wish to get married. For the purposes of this answer, I assume you wish to get married in Germany.

In certain cases, it is not possible for a person to provide a ‘No Impediment Certificate’, for example if it does not exist in their home country or, as in your case, they have refugee status.

For such cases, there is the option to provide a sworn statement about your marital status. This is called ‘eiddestattliche Versicherung’ and can be done at the German embassy (for people who are living in Germany this is done directly at the ‘Standesamt’ marriage registry office).

The German embassy in the UK does not provide any information on this option but here you can read (via online translation) about it from the German embassy in France:

thank you for sharing your question with us.

This is unfortunately a big problem for many people, who get help from Jobcenter or from Social Welfare Office (Sozialamt) in Germany. I don't know in which city of Germany you live, but in your city there might be some state owned- or -financed apartments, such as Sozialwohnungen, which you can apply for. Otherwise, you should not give up. There are still some landlords, who rent there apartments to those, who are supported by Jobcenter. It takes time and energy to search for such apartments and such landlords and find them, but eventually you can find them.

I don't know how the possibility of work for you and your family is, but if the possibility exists, you or another member of your family or more than one member of your family can start to work, so that you can find an apartment easily.

Is there any particular reason why you want to finish your current training immediately? And what would you like to do in the meantime until the new training year and potential new Ausbildung (August) starts?

I can always recommend to contact a migration counselling office for individual support in these matters as well.

da Sie schon ein Visum für Deutschland hatten, gehe ich davon aus, dass Sie eine Fiktionsbescheinigung nach Paragraf 81 Absatz 4 haben. Sie sehen das auf Seite 3 der Fiktionsbescheinigung. Der Punkt 'Der Aufententhaltstitel als fortbestehend' soll angekreuzt werden.

Mit der Fiktionsbescheinigung und einem gültigen Pass dürfen Sie ausreisen und nach Deutschland wieder einreisen. Ich gehe davon aus, dass diese Regelung der britishcen Grenzkontrolle bekannt ist aber wir können hier leider nur Informationen zu der Situation in Deutschland geben.

Firstly, as you have a lawyer he is he best person to be able to advise you on this. We are not lawyers and so I can only provide a general evaluation of your situation.

Some things are not clear to me in your question. You state your application was rejected due to a criminal offence. An application for residence on family grounds can only be rejected for serious criminal offences. If the offence is illegal entry to Germany or illegal overstay of your visa conditions, then these are not sufficiently serious offences.

It is also not clear why the rejection was not appealed and instead a letter was sent asking for a Duldung.

You child is entitled to a residence permit according to paragraph 33 of the residency law (Aufenthaltsgesetz).

You may be entitled to a residence permit due to your husband. He needs to earn enough to support himself, you and the baby financially. You will also have to show you speak A1 level of German. There are some exception to the German language rule, depending on what type of permit he had before getting permanent residency.

If you fulfil the requirements for a permit on family grounds, the authorities will most likely tell you to first leave Germany and apply for a visa for family reunification at a German embassy. As you have a baby, however, it is not reasonable for you to have to do this. It would require your child to be separated from you for possibly quite some time and in such cases the immigration office (Ausländerbehörde) should process your application here in Germany.

If the visa becomes an issue, it is important that your lawyer is aware of a recent case at the highest German court (Bundesverfassungsgericht). The circumstances of the case are different but the central question is whether it is reasonable to expect someone with a child to leave them to go and get a visa. The court ruled in favour of the applicant for a resident permit. Here is a brief report on it in English via online translation:
