&lt;p&gt;At present you are not eligible for naturalization. For this you need five years of legal residency. There was until recently a possibility for faster naturalization after three years (commonly referred to as ‘Turbo-Einbürgerung’) but this has been removed from the law.&lt;/p&gt;

&lt;p&gt;The periods spent with the status of Aufenthaltsgestattung, Duldung and Ausbildungsduldung cannot be counted towards these five years as they are not considered full legal residency. The relevant basis for this is paragraph 10 of the naturalization law (Staatsangehörigkeitsgesetz). The first requirement listed there is that it applies to:&lt;/p&gt;

&lt;p&gt;There may be some confusion as the rules are different when calculating the required time you needed for permanent residency. For permanent residency, the authorities can at their discretion include the time spent in the asylum procedure, even if the final decision was negative. For naturalization, the time in the asylum procedure is only counted if the person received full recognition as a refugee.&lt;/p&gt;

&lt;p&gt;In my view, you will fulfil the eligibility of five years of legal residence in Germany in December 2026. You may have not received your actual first legal permit until February 2022 but the decision was made in December 2021 and I would date your legal residency in Germany from that date.&lt;/p&gt;

Manchmal sind die Arbeitszeiten auch nicht festgelegt für Arbeitnehmer*innen. Das heißt ‚Gleitzeit‘. Bei Gleitzeit muss man meistens an bestimmten Zeiten bei der Arbeit sein, z.B. Montag bis Freitag immer 10 – 13:00. Ansonsten können sie aber selber entscheiden, wie sie ihre Arbeitsstunden leisten. Manche wollen jeden Tag früh anfangen, manche andere arbeiten lieber bis spät nachmittags.&lt;/p&gt;

&lt;p&gt;Sie können sich an die Agentur für Arbeit wenden. Die Agentur hat viele statistischen Informationen zum Arbeitsmarkt. Sie beraten auch Menschen wie Sie, die ein Unternehmen gründen möchten. &lt;p&gt;Based on the information you provide, in my view you need to change your intended place of residence. The fact that you are still married does not make a difference in this regard. If you do not have someone else you know in Germany that you can at first stay with, then **** for temporary accommodation such as a hostel, hotel, short-term rental.&lt;/p&gt;

&lt;p&gt;As part of the visa process, you are asked where in Germany you plan to live. However, there is not a requirement in your case to show that you have somewhere longer-term to stay. The requirement to have suitable accommodation is for other situations, such as a foreign person wishing to join their foreign spouse in Germany. As the parent of German children, this is not a requirement.&lt;/p&gt;

&lt;p&gt;The authorities have some discretion on whether to issue the visa as you are moving to Germany with your children rather than joining them in Germany. You can be given a visa but if must be clearly shown that you will no longer have Nigeria as your usual place of residence. You should at least be able to show you have somewhere to stay at first. Otherwise they may have concerns about the children’s welfare, i.e. that you would arrive in Germany without anywhere for your children to stay, in which case the authority in charge of child protection (Jugendamt) would be contacted.&lt;/p&gt;

&lt;p&gt;Any Ausländerbehörde has discretion on whether to issue a Niederlassungsleruabnis to a person with 25b. This is different, for example, to people who have full refugee recognition from BAMF. Such people have a full entitlement to be issued with one after a certain period of time.&lt;/p&gt;

&lt;p&gt;The rule concerning your situation is in paragraph 26, section 4 of the Aufenthaltsgesetz, here in English via online translation:&lt;/p&gt;

&lt;p&gt;&lt;em&gt;(4) Furthermore, a foreigner who holds a residence permit under this section &lt;strong&gt;may be granted&lt;/strong&gt; a settlement permit if the conditions set out in Section 9 (2) sentence 1 are met. Section 9 (2) sentences 2 to 6 apply accordingly. In derogation from Section 55 (3) of the Asylum Act, the period of residence during the asylum procedure preceding the granting of the residence permit shall be counted towards the time limit.&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;The main court ruling I could find about such cases was a decision by the federal administrative court (Bundesverwaltungsgericht) from 2011. It contains two main points:&lt;/p&gt;

&lt;ol&gt;

&lt;li&gt;The time spent in the asylum procedure should be included when calculating the required time for a Niederlassungserlaubnis, even if there was a negative decision and the person was in possession of a Duldung for some time.&lt;/li&gt;

&lt;li&gt;The Ausländerbehörde can require the person to have had a residence permit for a certain amount of time when calculating the time periods.&lt;/li&gt;&lt;/ol&gt;

&lt;p&gt;The second point is to prevent a situation where a person could have been in the asylum procedure for 4.5 years, then on a Duldung, then issued with a permit where they can then after 6 months get a Niederlassungslerlaubnis. A specific amount of time is not mentioned but the court makes reference to the guidelines for the Ausländerbehörde in Berlin that states the person must have had a permit for at least three years. I assume the second Ausländerbehörde you applied to is basing its decision on this.&lt;/p&gt;

&lt;p&gt;The immigration law (Aufenthaltsgesetz) is the same through Germany. How the law is implemented can vary to a certain degree from one federal state to another, due to guidelines that each state can produce.&lt;/p&gt;

&lt;p&gt;I do not fully understand this part of your question:&lt;/p&gt;

&lt;p&gt;&lt;em&gt;And had it been that the Auslandbehörde in my former city had decided that I should leave Germany, would the Auslandbehörde in my present city handled such decision differently? Wouldn't they have respected such decision?&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;In some matters each Ausländerbehörde is obliged to decide a certain way, in other matters there is discretion available to them on how to decide on a particular matter.&lt;/p&gt;

&lt;p&gt;The law that regulates the Ausländerbehörde and other government institutions is called Verwaltungsrecht (administrative law). This means a person can file a legal suit called a Klage with the Verwaltungsgericht if they have unsuccessfully appealed a decision of the Ausländerbehörde and wish to pursue it further.&lt;/p&gt;

&lt;p&gt;It is important to first clarify what type of unemployment benefit you might apply for. If you have been working and paying into the social security system (i.e. more than a minijob) for at least 12 of the past 30 months, then you are entitled to the benefit ‘Arbeitslosengeld’. You apply for this with the Agentur für Arbeit. It is important to know that you are obliged to register as job-seeking ‘arbeitssuchend’ with the Agentur für Arbeit within three working days of being informed you are losing your job.&lt;/p&gt;

&lt;p&gt;If you receive the benefit Arbeitslosengeld, there is no issue with your residency rights in Germany. The Arbeitslosengeld is an entitlement you have as a result of working and paying into the system.&lt;/p&gt;

&lt;p&gt;The situation is somewhat different with the benefit ‘Bürgergeld’ from the Jobcenter. You have the right to receive this benefit but the Jobcenter may inform the immigration office in this case. I cannot say with certainly whether the immigration office would be informed or not. There are some cases where as a rule this takes place. A common example is if a person come to Germany from another EU country and without having worked here, goes to the Jobcenter and applies for Bürgergeld. The Jobcenter will inform the immigration office and the immigration office will contact the person to examine their right to continue to stay in Germany.&lt;/p&gt;

&lt;p&gt;Your situation is different. You a not an EU citizen and so the Jobcenter can only share the information with the immigration for certain types of residency, namely work, training (Ausbildung) and studying. You have the permit Aufenthaltsdokument-GB which is a separate type of permit.&lt;/p&gt;

&lt;p&gt;Even if the immigration office was made aware that you are no longer financially self-sufficient, it does not mean you automatically lose your residency status. In practice, what generally happens is that the person is given some time to **** for a new job. In this time they can continue to get the support of the Jobcenter. Only if after a final deadline the person cannot show self-sufficiency, could the immigration office then cancel the residency permit and request the person to leave the country. But they also have discretion in assessing each case and so would also take into account the length of time you have been in Germany, that your wife is working, your kids are at Kita etc.&lt;/p&gt;

&lt;p&gt;Depending on your financial situation in the event of a job loss, an alternative to the Bürgergeld would be to apply for the benefits Kinderzuschlag (additional child benefit) and Wohngeld (rent support). These benefits, along with your wife’s income, Kindergeld and potentially Arbeitslosengeld for you, could then be enough combined to cover your costs. There is no issue with you receiving Kinderzuschlag and Wohngeld.&lt;/p&gt;

Upon arriving, I submitted my study progress from the online school and the enrollment for the new school to the Ausländerbehörde (Foreigners' Office), but was granted a residence permit for the course I had been doing online instead. I graduated from the online course on July 19, 2024, and am now unsure whether to submit my graduation documents to the Ausländerbehörde to get a post-study work visa but I am just skeptical because I heard that they may not grant it because the course was online, and I might need to complete my on-campus studies first, which would be stressful. &lt;p&gt;As Simi mentioned, most of the immigration offices are currently understaffed and procedures take way too long. So, waiting for several weeks or even months is unfortunaltey not unusual. However, I would highly encourage you to contact them again to highlight the importance of the extension of your work permit. The immigration office can also record the work permit on your &quot;Duldung&quot; for the time being or they may give you a paper which states that you will receive the residence permit (and you are allowed to work) but still have to wait for the residence card (which still needs to be produced). I recommend to ask a refugee/migration counselling office for support in this.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;You do not make it clear where you wish to get married. For the purposes of this answer, I assume you wish to get married in Germany.&lt;/p&gt;

&lt;p&gt;In certain cases, it is not possible for a person to provide a ‘No Impediment Certificate’, for example if it does not exist in their home country or, as in your case, they have refugee status.&lt;/p&gt;

&lt;p&gt;For such cases, there is the option to provide a sworn statement about your marital status. This is called ‘eiddestattliche Versicherung’ and can be done at the German embassy (for people who are living in Germany this is done directly at the ‘Standesamt’ marriage registry office).&lt;/p&gt;

&lt;p&gt;The German embassy in the UK does not provide any information on this option but here you can read (via online translation) about it from the German embassy in France:&lt;/p&gt;

&lt;p&gt;Firstly, as you have a lawyer he is he best person to be able to advise you on this. We are not lawyers and so I can only provide a general evaluation of your situation.&lt;/p&gt;

&lt;p&gt;Some things are not clear to me in your question. You state your application was rejected due to a criminal offence. An application for residence on family grounds can only be rejected for serious criminal offences. If the offence is illegal entry to Germany or illegal overstay of your visa conditions, then these are not sufficiently serious offences.&lt;/p&gt;

&lt;p&gt;It is also not clear why the rejection was not appealed and instead a letter was sent asking for a Duldung.&lt;/p&gt;

&lt;p&gt;You child is entitled to a residence permit according to paragraph 33 of the residency law (Aufenthaltsgesetz).&lt;/p&gt;

&lt;p&gt;You may be entitled to a residence permit due to your husband. He needs to earn enough to support himself, you and the baby financially. You will also have to show you speak A1 level of German. There are some exception to the German language rule, depending on what type of permit he had before getting permanent residency.&lt;/p&gt;

&lt;p&gt;If you fulfil the requirements for a permit on family grounds, the authorities will most likely tell you to first leave Germany and apply for a visa for family reunification at a German embassy. As you have a baby, however, it is not reasonable for you to have to do this. It would require your child to be separated from you for possibly quite some time and in such cases the immigration office (Ausländerbehörde) should process your application here in Germany.&lt;/p&gt;

&lt;p&gt;If the visa becomes an issue, it is important that your lawyer is aware of a recent case at the highest German court (Bundesverfassungsgericht). The circumstances of the case are different but the central question is whether it is reasonable to expect someone with a child to leave them to go and get a visa.
