You do not need to withdraw your application for asylum. You can receive a residence permit under § 28 while your asylum case continues. This rule is based on paragraph 10 of the immigration law (Aufenthaltsgesetz) which covers such circumstances:

You’ll see in section 1 that it mentions additional requirements in cases other than where there is a legal entitlement. As you have correctly mentioned, the resident permit for a parent of a German child is an entitlement permit (in German ‚gesetzlicher Anspruch‘).

For the resident permit as a parent to a German child you do not require any level of German.

I do not see any reason why your application should need to take any longer so yes you can send them a reminder message. If for some reason there are additional questions on your application for § 28, you could for now make a separate application based on your current Aufenthaltsgestattung to move in with your girlfriend and child. This application is called ‚Änderung der Wohnsitzauflage‘ and is accepted to allow family members to live together. This would provide additional proof of your relationship with your child if necessary, although the fact that you have confirmation from the mother of how you are caring for your child then this is already sufficient.

The requirements for residence permit 25b differ slightly from many other types of residence permits. Usually a particular permit has requirements X, Y, and Z and they must all be fulfilled in order for it to be issued.

25b is a permit that should be issued to a person with a Duldung who is considered to be 'sustainably integrated' (nachhaltig integriert). The legal text then goes on to state that such integration 'regularly requires' certain things, and then lists them. This means that generally a person has to fulfil all the requirements but exceptions can be made. An example would be if a person was heavily involved in their local community, volunteering with organisations etc. It is not enough that a person, for example, is a member of their local football club. They would have to be much more involved, like training the younger kids, organising competitions, attending meetings etc. over a longer period. Such engagement can be considered alternate proof of integration, meaning the authorities could accept it in place of the language requirement.

In most cases, however, the language will be required. Please note it is spoken German that is required, not the overall level including reading and writing. A certificate confirming this level of German is not strictly necessary. The Ausländerbehörde can also accept that a person has fulfilled this requirement if the person can speak comfortably in German at this level with the Ausländerbehörde.

Under certain circumstances the language requirement can be waived altogether. This is if it is not possible for the person to learn German to this level for reasons of illness, disability or old-age.

das ist eine wirklich blöde Situation. Ich erkläre erst mal ein paar Wichtige Informationen zu Unterhaltsvorschuss und Bürgergeld:

Unterhaltsvorschuss ist für Kinder von Alleinerziehenden gedacht, wenn der andere Elternteil keinen oder zu wenig Unterhalt zahlt. Er wird eigentlich beim Jugendamt beantragt – nicht beim Jobcenter.
Das Jobcenter kann Dich auffordern, Unterhaltsvorschuss zu beantragen oder den Antrag selbst stellen, wenn es denkt, dass ein Anspruch besteht. - Das scheint hier der Fall gewesen zu sein.
Wenn Du wieder verheiratet bist und mit Deiner neuen Partnerin zusammenlebst, giltst Du nicht mehr als alleinerziehend und hast keinen Anspruch mehr auf Unterhaltsvorschuss - das stimmt also leider.
Der Unterhaltsvorschuss wird auf das Bürgergeld (früher Hartz IV) angerechnet.
Wenn Du Leistungen zu Unrecht bekommen hast (zum Beispiel weil Du wieder verheiratet warst), kann das Jugendamt das Geld zurückfordern.

So, jetzt aber zu den Lösungen. Was Du jetzt tun kannst:

Hast du dem Jobcenter und Jugendamt denn deine Hochzeit gemeldet? Wenn ja:

1. Widerspruch gegen den Rückforderungsbescheid einlegen
Leg sofort schriftlich Widerspruch beim Jugendamt gegen die Rückforderung ein. Erkläre, dass das Jobcenter den Antrag gestellt hat, obwohl Du alle Unterlagen – inklusive Heiratsurkunde – vorgelegt hast und nicht wusstest, dass Du keinen Anspruch mehr hattest.
Füge alle Nachweise bei – besonders die Kopie Deiner Heiratsurkunde und die Korrespondenz mit dem Jobcenter.

2. Nachweise für Deine Situation sammeln
Sammle alle Belege, dass Du dem Jobcenter und dem Jugendamt Deine neue Ehe gemeldet hast (z. B. Kopien von Briefen, E-Mails, Eingangsbestätigungen).
Halte fest, dass Du den Antrag nicht selbst ausgefüllt, sondern nur auf Aufforderung des Jobcenters unterschrieben hast.

3. Prüfen, ob Du Anspruch auf andere Leistungen hast
Da Du keinen Anspruch mehr auf Unterhaltsvorschuss hast, prüfe, ob Du vielleicht Kindergeld, Wohngeld oder andere Familienleistungen bekommen kannst. Kindergeld zB kannst Du auch noch 6 Monate rückwirkend beantragen.

Wichtig:

Grundsätzlich haftest Du für falsche Angaben im Antrag. Aber wenn Du nachweisen kannst, dass das Jobcenter den Antrag ausgefüllt hat und Du alle Infos korrekt angegeben hast, kann das Deine Verantwortung verringern.
Keine Panik. Aber in diesem Fall ist es sicherlich sinnvoll mit allen Unterlagen zu einer Beratung vor Ort zu gehen.
Die Betreuungskosten für Deine Kinder kannst Du eventuell an anderer Stelle geltend machen – zum Beispiel beim Jugendamt oder über steuerliche Freibeträge. Also auch hier alle Belege zusammen suchen.

Zusammenfassung

Lege sofort Widerspruch gegen den Bescheid ein.
Hol Dir rechtliche Beratung und Unterstützung.
Sammle alle Nachweise, dass Du Deine Ehe gemeldet hast.
Prüfe, ob Dir andere Leistungen zustehen.

If you plan to take the driving license training and test in a city that does not correspond to your first place of residence, please note the following: The "Straßenverkehrsamt" at the place of your first place of residence must approve that the training and test place is different. This is important, for example, for anyone who wants to get their driving license at a holiday driving school. The decision is at the discretion of the authority.

This regulation is about road safety reasons. The aim is to prevent, for example, a driver's license applicant who, given their place of residence, will mainly be involved in the traffic of a large city, from taking the test in a region with little traffic. Therefore, be sure to clarify beforehand (source: ADAC)!

I wanted to share with you the information that there is an option to make a "Teilzeitausbildung" (vocational training in part-time) which allows you to actually start a training even as a single mother. I highly recommend to get some individual support in a counselling office. They can help you searching for an appropriate vocational training place, praparing your application documents and may also be able to help with child care questions.

Aber das Problem ist, dass ich ohne einen gültigen Pass keine Möglichkeit habe, diesen gegen eine deutsche Aufenthaltsgenehmigung einzutauschen, und das ist ein Problem, bei dem ich Sie fragen möchte, wie Sie es gelöst haben!

No, the child’s father cannot benefit from the status you and your daughter have. He must himself fulfil the requirements for a residence permit, for example the same ones you had to fulfil in order to get 25b. In order to get 25b he will have to have been in Germany for 6 years. This is only shortened to 4 years if someone has a child that they are living with. If your daughter is living with him part of the time, then he could have the required length of time reduced to 4 years.

Hi. From my own experience l had a Aufenthaltsgestattung,no Duldung and my passport was valid with BAMF. When l went to Standesamt, l was given the required documents to bring. We had enough time to gather the documents and have all of them legalised in my home country. The moment you submit the forms that you want to marry BAMF will be notified. So don't be surprised if you get a deportation letter or the same drama you explained.

l was given a copy of my passport from Auslaenderbehoerde and submitted that together with all the documents to Standesamt. After the wedding you can then book an appointment with Auslaenderbehoerde to apply for a resident permit alongside with your partner's documents. All of this was done without a lawyer.

I shared this hoping it can help you. With the whole process you need 6months- 1 year depending with the documents you have here. A valid passport is required and soon you submit it at Standesamt they will not give you back but hand it over to Auslaenderbehoerde.

Example: A friend had an expired passport and when it expired she was asked to bring a new passport. The passport was taken away immediately it arrived in Germany via courier. Meaning you will not be in position of your passport until you have resident permit

Please engage a lawyer otherwise all the effort will be for nothing. Lastly make sure you are marrying for the right reasons and read the marriage law in Germany. l later divorced a man whom at that time l regret marrying The process for divorce took years.

The "Renteninformation" (pension information) is indeed not the same as the "Rentenversicherungsverlauf"(pension insurance history). The pension information shows your predicted statutory pension at the start of your regular pension, your pension entitlement to date and, if the worst comes to the worst: the current status of your entitlement to a disability pension. If you didn't receive one lately, you may apply for it here.

The "Rentenversicherungsverlauf" contains a chronological overview of your insurance periods and earnings which the German pension insurance company has saved.

I answered a question of yours on this relatively recently with some information on the Standesamt and getting assistance locally from the Johanniter organisation. You now write that you have exhausted your efforts. It would be easier for me to answer your question if I knew what these efforts were and why they were not successful.

As your partner is pregnant, that is an additional reason for you to be allowed to stay. Expectant fathers are entitled to get a visa to come to Germany already during the pregnancy. Strictly speaking, the authorities could tell you to first leave Germany and apply for a visa at the German embassy. Depending on the stage of pregnancy and the length of visa processing times in Ghana, you can then argue that this is unreasonable and you should be provided with a visa directly here. You would first have to do a declaration of paternity (Vaterschaftsanerkennung) and, if possible, declaration of shared custody (Sorgerechtserklärung) at the local Jugendamt.

In addition to your status as an expectant father, you have the additional options of applying for a residence permit as a partner of an EU citizen or, if you get married, as the spouse of an EU citizen.

The easiest would be if your partner is an EU-citizen since he would be allowed to move freely within the EU. In case he is a third country national, it is slightly more complicated as he needs to apply for a visa (it is not that you can apply for a residence permit for him here). For this, the following questions will be relevant: Are you two married? If yes, did you marry before or after you left your country of origin? Did he officially recognise the paternity/do you share the custody for the children? Which residence permit are you/the children holding? Which status does he have in Malta?

Hi. If your wife is still under Asylum she isn't allowed to bring any family members to Germany. If she revokes her Asylum case she will be deported to her 1st country of entry in EU or back to country of origin.

If you wish to do a BFD, you need to find an organisation where you can do this voluntary service. There are many opportunities available in different sectors, e.g. working with older people, young people, cultural activities, sports.

You will not be allowed to register your residential address on a expired visa. A valid passport and residence permit are required to officially marry in Germany. The office responsible for this is called the Standesamt. Additionally, you will need to provide a certificate of single status from your home country, as German law permits only one marriage at a time.

Just so you know. If authorities suspect a sham marriage, the municipality conducts investigations. You and your partner are interviewed separately about your relationship. These investigations involve cooperation with the police and immigration authorities. Providing false information during the interview may result in imprisonment.

As UNHCR states also on their website, there are no (UNHCR) resettlement programmes for travelling from Germany to another state such as Canada or the United States. For plausible reasons, they focus on people who are not in a safe country yet.

Yes, your nationality plays a big role in this.

As long as you have Syrian nationality only, the situation is as follows:

If you have a child with your girlfriend, you can make an application for the child to come to Germany. It is at the discretion of the authorities whether to allow this, i.e. there is not an automatic right. They allow it for humanitarian reasons and with the welfare of the child as most important. Your residency status also pays a role as the rules are different depending on your residency. The mother would have to give her permission for the child to come.

If the child receives a permit, then the mother can apply to come to Germany as the parent of a child who has a residence permit. However, this is quite difficult and is only approved in cases where there would otherwise be an extraordinary hardship.

If you get German nationality and the child is then born with German nationality, the situation changes. The child as a German has the right to come and live in Germany. The mother has the right to come and live as the parent of a German child.

Don’t worry about the length of your message or any vagueness. We get all kinds of questions here and are happy to answer them all as best we can. I’m sorry to read of your situation but glad that you wrote us and are open to getting some help with things.

In order to make your situation more stable, I would recommend at first applying for benefits (Bürgergeld) from the Jobcenter. It is best to do this by the end of the month as the benefits can only be backdated to the start of the month the application is made. The Jobcenter involves a lot of forms and paperwork but the main thing is to apply for now. You can get help with the forms if you need. Your local Jobcenter may have a service that help people with their application called something like ‘Erstantragstellung’. They may be able to provide a translator for this. Otherwise you can go to a migrant advice service in your area for help with this and more generally for any assistance you need. You can search for one in your area here:

The Jobcenter will also pay your health insurance from the time you apply. If you have built up unpaid health insurance contributions, it could be that your entitlements to healthcare are restricted to emergency treatment. As an example, the organisation Malteser provide health clinics in 18 different cities in Germany:

It is not clear from your question what kind of residency status you have at the moment. If you get a residency permit for work purposes or become a German citizen, then yes your wife can change from Ausbildung visa to spouse residence permit. The requirements for this are different whether she is applying as the spouse of a foreign person with a residency permit or the spouse of a German citizen.

If a person becomes pregnant during an Ausbildung, then they are legally protected like other workers. She will have to inform her employer and if necessary ask the immigration authority (Ausländerbehörde) for an extension of her permit. There is a period of 6 weeks before the birth and 8 weeks after the birth where the mother is not allowed to work in order to protect her health. This is called ‚Mutterschutrzfrist‘. After that there is the possibility to take parental leave ‚Elternzeit‘. An important condition if extending the residence permit is that she has enough money to support herself during the entire extension period.

However, I recommend to double check your residence permit card or the "Zusatzblatt" (the usuall green supplementary sheet) that it actually includes the work permit. If you can not find the respective information, you should talk to the immigration office about it.

The relevant legal basis is paragraph 62, section 2 of the ‘Einkommenssteuergesetz’:

As far as I know, it’s normal that the immigration office issued the electronic residence permit (the card) instead of putting a sticker in your passport (which was, if I’m not mistaken, the old procedure). Together with your valid passport and your residence permit card you should be able to travel!

Keep in mind, though, that you still have to renew the residence permit card in case you renew your passport as the residence permit usually refers to your passport.

You need to find a job which requires a third-level university or vocational qualification. Going on Elternzeit does not affect your Blue Card. You still have your job and that is the requirement for a Blue Card.

A problem which may arise is to do with how much Elterngeld you will be receiving. As long as this is enough to cover the living costs for you and, at a later point, your child, there is no issue. If, however, it is below the minimum required amount to live on then it can affect your residency status. Be aware that you will be entitled to Kindergeld. Depending on your income, you may be entitled to additional child supplement (Kinderzuschlag) which does not affect your residency.

As for the Niederlassungserlaubnis, in my view you would not be entitled to it during the Elternzeit. Assuming the income you have is enough to cover you and your child, then the key requirement is to have worked for 21 months. In German, the laws refers to 'eine Beschäftigung ausgeübt'. As I understand it, this means not just to have a job (i.e. a job contract) but to be actively working at it for 21 months. However, I haven't been able to find any concrete information as to whether a person in Elternzeit is still considered to be actively working.

You can apply for the Niederlassungserlaubnis and either the Ausländerbehörde accept you have fulfilled the 21 months and issue it or you will stay on the Blue Card (with the key requirement of being able to support yourself and your child financially).

I am not sure whether I understand your question correctly.

Recognised refugees are not allowed to request services (including the issuance of a national passport) of their country of origin's governement/embassies. Otherwise they would risk their refugee status in Germany. Instead, they may be issued a refugee passport ("blue passport") by the local immigration office (Ausländerbehörde).

However, I assume that you are living in Germany under "temporary protection" - holding a residence permit according to section 24 of the German Residence Act, as the majority of the Ukrainians in these days?

If this is the case, you should apply at the Ukrainian embassy in Berlin or at one of the consulates for an Ukrainian passport. Please see the embassy's website for more details.

You did not mention if your wife is working or not. Your rights of residency in Germany are based on whether she is making use of her special freedom of movement rights as an EU citizen in Germany. Most commonly this is done by having a job of at least 8 hours a week. If this is the case, you are entitled to a residence permit as her spouse and will have the right to work.

You need to provide this proof of her freedom of movement rights (e.g. with a work contract for her) along with your own documentation to the Ausländerbehörde and they should issue you with a residence permit. Please be aware that due to your own residency history in Germany (as much as I can tell from your question), the Ausländerbehörde may question you about the legitimacy of the marriage.

You do not need a lawyer to apply for a residence permit.
