&lt;p&gt;For the resident permit as a parent to a German child you do not require any level of German.&lt;/p&gt;

&lt;p&gt;I do not see any reason why your application should need to take any longer so yes you can send them a reminder message. If for some reason there are additional questions on your application for § 28, you could for now make a separate application based on your current Aufenthaltsgestattung to move in with your girlfriend and child. This application is called ‚Änderung der Wohnsitzauflage‘ and is accepted to allow family members to live together. This would provide additional proof of your relationship with your child if necessary, although the fact that you have confirmation from the mother of how you are caring for your child then this is already sufficient.&lt;/p&gt;

&lt;p&gt;The requirements for residence permit 25b differ slightly from many other types of residence permits. Usually a particular permit has requirements X, Y, and Z and they must all be fulfilled in order for it to be issued.&lt;/p&gt;

&lt;p&gt;25b is a permit that should be issued to a person with a Duldung who is considered to be 'sustainably integrated' (nachhaltig integriert). The legal text then goes on to state that such integration 'regularly requires' certain things, and then lists them. This means that generally a person has to fulfil all the requirements but exceptions can be made. An example would be if a person was heavily involved in their local community, volunteering with organisations etc. It is not enough that a person, for example, is a member of their local football club. They would have to be much more involved, like training the younger kids, organising competitions, attending meetings etc. over a longer period. Such engagement can be considered alternate proof of integration, meaning the authorities could accept it in place of the language requirement.&lt;/p&gt;

&lt;p&gt;In most cases, however, the language will be required. Please note it is spoken German that is required, not the overall level including reading and writing. A certificate confirming this level of German is not strictly necessary. The Ausländerbehörde can also accept that a person has fulfilled this requirement if the person can speak comfortably in German at this level with the Ausländerbehörde.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;Under certain circumstances the language requirement can be waived altogether. This is if it is not possible for the person to learn German to this level for reasons of illness, disability or old-age.&lt;/p&gt;

&lt;br&gt;das ist eine wirklich blöde Situation. Ich erkläre erst mal ein paar&amp;nbsp;&lt;strong&gt;Wichtige Informationen&amp;nbsp;zu Unterhaltsvorschuss und Bürgergeld:&lt;/strong&gt;&lt;/p&gt;

&lt;ul&gt;

&lt;li&gt;

&lt;p&gt;Unterhaltsvorschuss ist für Kinder von Alleinerziehenden gedacht, wenn der andere Elternteil keinen oder zu wenig Unterhalt zahlt. Er wird eigentlich beim Jugendamt beantragt – nicht beim Jobcenter.&lt;/p&gt;&lt;/li&gt;

&lt;li&gt;

&lt;p&gt;Das Jobcenter kann Dich auffordern, Unterhaltsvorschuss zu beantragen oder den Antrag selbst stellen, wenn es denkt, dass ein Anspruch besteht. - Das scheint hier der Fall gewesen zu sein.&lt;/p&gt;&lt;/li&gt;

&lt;li&gt;

&lt;p&gt;Wenn Du wieder verheiratet bist und mit Deiner&amp;nbsp;neuen Partnerin zusammenlebst, giltst Du nicht mehr als alleinerziehend und hast keinen Anspruch mehr auf Unterhaltsvorschuss - das stimmt also leider.&lt;/p&gt;&lt;/li&gt;

&lt;li&gt;

&lt;p&gt;Der Unterhaltsvorschuss wird auf das Bürgergeld (früher Hartz IV) angerechnet.&lt;/p&gt;&lt;/li&gt;

&lt;li&gt;

&lt;p&gt;Wenn Du Leistungen zu Unrecht bekommen hast (zum Beispiel weil Du wieder verheiratet warst), kann das Jugendamt das Geld zurückfordern.&lt;/p&gt;&lt;/li&gt;&lt;/ul&gt;

&lt;p&gt;&lt;strong&gt;So, jetzt aber zu den Lösungen. Was Du jetzt tun kannst:
&lt;br&gt;
&lt;br&gt;Hast du dem Jobcenter und Jugendamt denn deine Hochzeit gemeldet? Wenn ja:&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;1. Widerspruch gegen den Rückforderungsbescheid einlegen&lt;/strong&gt;
&lt;br&gt;Leg sofort schriftlich Widerspruch beim Jugendamt gegen die Rückforderung ein. Erkläre, dass das Jobcenter den Antrag gestellt hat, obwohl Du alle Unterlagen – inklusive Heiratsurkunde – vorgelegt hast und nicht wusstest, dass Du keinen Anspruch mehr hattest.
&lt;br&gt;Füge alle Nachweise bei – besonders die &lt;strong&gt;Kopie Deiner Heiratsurkunde &lt;/strong&gt;und die &lt;strong&gt;Korrespondenz mit dem Jobcenter.&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;2. Nachweise für Deine Situation sammeln&lt;/strong&gt;
&lt;br&gt;Sammle alle Belege, dass Du dem Jobcenter und dem Jugendamt Deine neue Ehe gemeldet hast (z. B. Kopien von Briefen, E-Mails, Eingangsbestätigungen).
&lt;br&gt;Halte fest, dass Du den Antrag nicht selbst ausgefüllt, sondern nur auf Aufforderung des Jobcenters unterschrieben hast.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;3. Prüfen, ob Du Anspruch auf andere Leistungen hast&lt;/strong&gt;
&lt;br&gt;Da Du keinen Anspruch mehr auf Unterhaltsvorschuss hast, prüfe, ob Du vielleicht Kindergeld, Wohngeld oder andere Familienleistungen bekommen kannst. Kindergeld zB&amp;nbsp;kannst Du auch noch 6 Monate rückwirkend beantragen.&lt;/p&gt;

&lt;br&gt;
&lt;br&gt;&lt;strong&gt;Wichtig:&lt;/strong&gt;&lt;/p&gt;

&lt;ul&gt;

&lt;li&gt;

&lt;p&gt;Grundsätzlich haftest Du für falsche Angaben im Antrag. Aber wenn Du nachweisen kannst, dass das Jobcenter den Antrag ausgefüllt hat und Du alle Infos korrekt angegeben hast, kann das Deine Verantwortung verringern.&lt;/p&gt;&lt;/li&gt;

&lt;li&gt;

&lt;p&gt;Keine Panik. Aber in diesem Fall ist es sicherlich sinnvoll mit allen Unterlagen zu einer Beratung vor Ort zu gehen.&amp;nbsp;&lt;/p&gt;&lt;/li&gt;

&lt;li&gt;

&lt;p&gt;Die Betreuungskosten für Deine Kinder kannst Du eventuell an anderer Stelle geltend machen – zum Beispiel beim Jugendamt oder über steuerliche Freibeträge. Also auch hier alle Belege zusammen suchen.&amp;nbsp;&lt;/p&gt;&lt;/li&gt;&lt;/ul&gt;

&lt;p&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Zusammenfassung&lt;/strong&gt;&lt;/p&gt;

I wanted to share with you the information that there is an option to make a &amp;quot;Teilzeitausbildung&amp;quot; (vocational training in part-time) which allows you to actually start a training even as a single mother. I highly recommend to get some individual support in a counselling office. They can help you searching for an appropriate vocational training place, praparing your application documents and may also be able to help with child care questions.&lt;br /&gt;

Ich weiß schon, wenn der Antragsteller eine Ausbildungsduldung beantragen will, kann er sie im Voraus beantragen, aber die ABH wird die Dokumente nicht für ihn ändern, weil der Antragsteller die Aufenthaltsgestattung genommen hat, um in Deutschland eine Ausbildung zu machen, und das ist genug, aber ich verstehe ein Detail nicht, mein Pass ist jetzt in den Händen der ABH, und wenn ich vom Bamf abgelehnt werde und das Bamf mich innerhalb von dreißig Tagen ausreisen lässt, kann ich während der Berufungsfrist eine Ausbildung beantragen, oder nicht? Wenn mein derzeitiger Pass in den Händen der ABH ist, wenn er vom Bamf abgelehnt wird und das Bamf mir 30 Tage Zeit gibt, um auszureisen, kann ich während der Berufungsfrist vor Gericht eine Ausbildung beantragen, oder? Nur die ABH wird mich nicht in eine Ausbildungsduldung umtauschen, weil ich eine Aufenthaltsgestattung habe, die ich erst umtauschen kann, wenn alle Asylverfahren abgeschlossen sind.&lt;br /&gt;
Zweitens weiß ich bereits von der 3+2-Regel für Deutschland, wenn ich also eine zweijährige Ausbildung beantrage, ist das auch möglich, oder? Denn ein teil Ausbildung hat 3jahre und ein teil Ausbildung ist 2 Jahre &lt;br /&gt;
Drittens, das ist meine größte Sorge, mein Pass wird am 02.2026 ablaufen, wenn ich meine Ausbildung erfolgreich abschließe und mein IHK Prüfungszeugnis bekomme, muss ich meine Ausbildungsgeduldung gegen eine Aufenthaltserlaubnis eintauschen, aber mein Pass muss bis dahin abgelaufen sein, wenn ich zur Botschaft in meinem Heimatland gehe, werde ich meinen Pass nicht umtauschen können, weil sie auf jeden Fall meinen deutschen Aufenthaltmittel wollen. Aber das Problem ist, dass ich ohne einen gültigen Pass keine Möglichkeit habe, diesen gegen eine deutsche Aufenthaltsgenehmigung einzutauschen, und das ist ein Problem, bei dem ich Sie fragen möchte, wie Sie es gelöst haben!</description>

He must himself fulfil the requirements for a residence permit, for example the same ones you had to fulfil in order to get 25b. In order to get 25b he will have to have been in Germany for 6 years. This is only shortened to 4 years if someone has a child that they are living with. If your daughter is living with him part of the time, then he could have the required length of time reduced to 4 years.&lt;/p&gt;

<description>Hi. From my own experience l had a Aufenthaltsgestattung,no Duldung and my passport was valid with BAMF. When l went to Standesamt, l was given the required documents to bring. We had enough time to gather the documents and have all of them legalised in my home country. The moment you submit the forms that you want to marry BAMF will be notified. So don't be surprised if you get a deportation letter or the same drama you explained.&lt;br /&gt;
&lt;br /&gt;
l was given a copy of my passport from Auslaenderbehoerde and submitted that together with all the documents to Standesamt. After the wedding you can then book an appointment with Auslaenderbehoerde to apply for a resident permit alongside with your partner's documents. All of this was done without a lawyer.&lt;br /&gt;

&lt;p&gt;It is not clear from your question what kind of residency status you have at the moment. If you get a residency permit for work purposes or become a German citizen, then yes your wife can change from Ausbildung visa to spouse residence permit. The requirements for this are different whether she is applying as the spouse of a foreign person with a residency permit or the spouse of a German citizen.&lt;/p&gt;

&lt;p&gt;If a person becomes pregnant during an Ausbildung, then they are legally protected like other workers. She will have to inform her employer and if necessary ask the immigration authority (Ausländerbehörde) for an extension of her permit. There is a period of 6 weeks before the birth and 8 weeks after the birth where the mother is not allowed to work in order to protect her health. This is called ‚Mutterschutrzfrist‘. After that there is the possibility to take parental leave ‚Elternzeit‘. An important condition if extending the residence permit is that she has enough money to support herself during the entire extension period.&lt;/p&gt;

&lt;p&gt;Going on Elternzeit does not affect your Blue Card. You still have your job and that is the requirement for a Blue Card.&lt;/p&gt;

&lt;p&gt;A problem which may arise is to do with how much Elterngeld you will be receiving. As long as this is enough to cover the living costs for you and, at a later point, your child, there is no issue. If, however, it is below the minimum required amount to live on then it can affect your residency status. Be aware that you will be entitled to Kindergeld. Depending on your income, you may be entitled to additional child supplement (Kinderzuschlag) which does not affect your residency.&lt;/p&gt;

&lt;p&gt;As for the Niederlassungserlaubnis, in my view you would not be entitled to it during the Elternzeit. Assuming the income you have is enough to cover you and your child, then the key requirement is to have worked for 21 months. In German, the laws refers to 'eine Beschäftigung ausgeübt'. As I understand it, this means not just to have a job (i.e. a job contract) but to be actively working at it for 21 months. However, I haven't been able to find any concrete information as to whether a person in Elternzeit is still considered to be actively working.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;You can apply for the Niederlassungserlaubnis and either the Ausländerbehörde accept you have fulfilled the 21 months and issue it or you will stay on the Blue Card (with the key requirement of being able to support yourself and your child financially).&lt;/p&gt;

Your rights of residency in Germany are based on whether she is making use of her special freedom of movement rights as an EU citizen in Germany. Most commonly this is done by having a job of at least 8 hours a week. If this is the case, you are entitled to a residence permit as her spouse and will have the right to work.&lt;/p&gt;

&lt;p&gt;You need to provide this proof of her freedom of movement rights (e.g. with a work contract for her) along with your own documentation to the Ausländerbehörde and they should issue you with a residence permit. Please be aware that due to your own residency history in Germany (as much as I can tell from your question), the Ausländerbehörde may question you about the legitimacy of the marriage.&lt;/p&gt;

&lt;p&gt;You do not need a lawyer to apply for a residence permit.&lt;/p&gt;</description>

It is a big step to choose another citizenship. It raises many questions that want to be well thought out. Perhaps my thoughts can contribute to this. It is quite possible to have two different residence titles. This is the case, for example, with the settlement permit or permanent residence-EU, because they are based on different entitlements. They have many of the same rights, but the EU permanent residence permit is more far-reaching due to the possibility of further migration, the stronger protection against expulsion or in the event of a possible revocation. It is different with naturalisation. It is not a residence title and you no longer need one because you are German - with all rights and obligations. Therefore, these two applications contradict each other. In this sense, you must first clarify for yourself what you personally want and what is important to you.
