Answered: Struggling with overcrowded Gemeinschaftsunterkünfte

First of all, I'm sorry that you find yourself in a difficult situation. Unfortunately, accommodation for asylum seekers or tolerated people (holding a so-called "Duldung") in the "Gemeinschaftsunterkünfte" is often not very comfortable and very stressful for the residents.

I'm afraid it won't be easy to convince the authorities that your current accommodation is unacceptable/unbearable. I would recommend that you seek support from social services ("Sozialdienst" in your accomodation) or an advice center (you may find one close-by using this search engine). In order to be able to claim medical reasons for a change of accommodation, you will need a detailed medical certificate. If I understand correctly, you will need to submit a transfer application to the government reception center in Upper Bavaria (attaching your medical certificate). You can find the relevant form on this website.

However, I would also like to follow up and ask whether you managed to obtain the residence permit according to section 25b after you were holding the so-called "Chancen-Aufenthaltsrecht" (§104c)? If that's the case, you can move into a private apartment, or rather, you should. Are you currently working?

Answered: Einbürgerung of a minor child

The father must give his consent for your child to do the Einbürgerung. I have looked into this question and have not found any specific law or administrative guideline where it states that both parents with shared custody must be present when submitting the application or when the child is granted German citizenship.

The father will certainly have to co-sign the child’s application form for citizenship with you.

If he cannot attend the immigration office in person, then he must in addition give his written consent to the Einbürgerung.

The office in Berlin, for example, does not mention anything about the presence of both parents, only that the other parent with custody must provide their consent:

„Für Kinder unter 16 Jahren mit gemeinsamen Sorgerecht der Eltern: Einverständniserklärung des anderen sorgeberechtigten Elternteils“

They also provide a sample form (Muster: Einverständniserklärung des anderen Sorgeberechtigten) which the parent fills out, signs and submits with a copy of their signature as it appears on their ID:

The authorities may require him to have this document notarised. This means that the father must sign it in the presence of a notary. The notary checks his identity and give an official seal confirming that he did indeed sign it. The authorities in Berlin do not mentioned requiring this but it is generally required in important administrative matters to be absolutely sure of the identity of the person who signs a document. This type of notarisation is called ‘offizielle Bglubigung’.

There is another type called ‘amtliche Beglaubigung’ which can be done at the father’s local Bürgeramt/ Rathaus (the office for local administrative tasks such as doing an Anmeldung) if he lives in Germany. This is cheaper than going to a notary and in my view is also sufficient to present to a German authority in this case.

There is no reason to apply for Alleinige Sorgerecht with regard to citizenship. It is not a requirement for citizenship, only the father’s consent is a requirement. How you decide on custody arrangements is a family matter and not something that an immigration officer should be pressuring you about. If the officer persists in this, request the legal basis (gesetzliche Grundlage) for it.

I agree with the view of the social worker you spoke with. If a person has a Wohnsitzauflage and finds an Ausbildung, then that person is allowed to move. If they are married, their spouse can also move and likewise if they have children. It would only be possible for your mother to move with you (and your brother if he is under 18) if you yourself were still under 18.

You can see the rules around this in paragraph 12a of the immigration law (Aufenthaltsgesetz):

Section 5 covers how a person can have the Wohnsitzauflage removed. If you **** at part two of that section, you’ll see that it does mention the possibility to allow a move in order to prevent a particular hardship. It does not clearly define what is considered a difficult enough situation for this. The authorities will decide on a case by case basis. If your family members wish to apply for removal of the Wohnsitzauflage based on the hardship rule, then they have to make a strong argument. Especially important to mention are any medical needs your family members may have that staying together as a family unit can help with, or any other support you and your family members offer each other on a regular basis.

The application is called ‘Antrag auf Aufhebung der Wohnsitzauflage’. You apply with the Ausländerbehörde where you are living now and they will forward it to the Ausländerbehörde of the place you wish to move. You send proof of your Ausbildung with the application. Some authorities have specific forms to make this application. Otherwise you can just write it yourself. This site has a good sample application you can use, it’s in the section ‘Unterbringung, Umverteilung, Wohnsitzauflagen’:

Here some general information of the declaration of custody:

The declaration of custody (Sorgerechtserklärung) is a declaration of intent by the parents to the youth welfare office or a notary that they will take joint custody of the child. It is necessary if the parents are unmarried at birth. Because then the mother has sole custody. If both parents are already married when the child is born, they automatically have joint custody. In this case, a declaration of custody is not necessary.

I am not an expert on family law, but it sounds to me that you might have stated the joint custody already since you "have Vaterschaft and Sorgerechtserklärung". Since there seem to be some apects unclear, I recommend you to get in touch with a refugee/migration counselling office (you may use this search engine to find a service in your area). Together you could check your documents and they can also support you with the naturalisation process.

You’re welcome!

The only difference I can foresee if you get married is to do with your financial security (in German ‘Lebensunterhaltsicherung’). Once married, you and your spouse have financial obligations to provide for one another, depending on whether you are working, doing childcare etc. For example, if your spouse is not working, then the amount you have to show the Ausländerbehörde that you have will be more as you need to cover their costs too.

If you think that you do not have enough money from Kindergeld and work to show financial security, you can apply for the benefits Kinderzuschlag (additional child benefit from the Familienkasse) and Wohngeld (rent supplement benefit from the Sozialamt). Getting these benefits does not affect your right to citizenship.

Thank you very much for your explanation. I was alone mean that I was not like families. And from what I noticed, refugee with group is process faster and better.

I will **** up for more information about the form you told me.

My roommate not respect anyone. He turns on the room light when he come back from work around 23:00, but when I study with my desk light at night, he requests me to turn it off because he can't sleep. He sometimes uses blender around midnight, use vacuum cleaner at Sunday evening till the neighbour come knock on the door to tell him and he said, he sleeps in the morning. And so much more problems. When I'm try to talk with him, he keeps saying don't understand what I'm saying. I understand houseowner try to help, but they have limitation and I’m try to learn by myself to solve my problem other ways.

I presume they are asking for this to examine any child support payments he should be making. Your daughter’s father is obliged to pay child support as long as he is financially able to do so. This why they are asking about his income. If you are not able to cover the costs for you and your daughter from your own income, you can apply for the benefits Kinderzuschlag, Wohngeld and Unterhaltsvorschuss. The Unterhaltsvorschuss is a payment from the Jugendamt to single parents if the other parent is unable or unwilling to pay child support. Getting these benefits does not affect your right to German citizenship.
This is not a problem. Your daughter has your nationality, as is clear by having a passport from that country. What is written on the back of her birth certificate is not about her nationality. Parents of different nationalities can choose which laws around naming a child are applied when naming their child. In her case, you chose the naming laws from the father’s country. This does not affect her nationality.

The only recommendation I have is to follow the course of action I outlined in my previous answer, i.e. make a written application to be housed elsewhere (Antrag auf dezentrale Unterbringung). Only if you do this can your arguments about being vulnerable be assessed properly. Otherwise you are likely to continue to receive the same responses you have to up to now, e.g. it is not possible, it is maybe possible later, you do not fulfil the requirements of vulnerable etc.

It is not a question of suing the Sozialamt. It is about having your wish to be housed in separate accommodation properly assessed. If it is turned down, you can appeal the decision. If the appeal is also turned down, then you have the option of going to court on this issue. In my previous answer I provided detail on how to make the application and what kind of information you should provide in it to show that the conditions are not suitable there. There is no guarantee it will be approved but it at least offers you the chance to set out your case in detail and get a more thorough reply than you have up to now.

Firstly, you’re very welcome. I’m glad our work is appreciated.

If you are not receiving any asylum seeker benefits from the Sozialamt, then you are no longer obliged to live in a particular place in Germany. You make an application to have this obligation removed. It is called ‘Antrag auf Aufhebung der Wohnsitzauflage’. Often people refer to this application as ‘Antrag auf Umverteilung’ but this is not strictly correct. ‘Umverteilung’ means a person is assigned a new place of residence, for example because they have family members there. In your case it is the ‘Aufhebung’ that is appropriate, because you no longer receive benefits.

You make this application with your local Ausländerbehörde in Freiburg. It is first checked by them before being forwarded to the Ausländerbehörde in Potsdam. If they also say it is ok, then you can move. You can use the form provided by the city of Freiburg here:

You can see also in that form that they use the term Umverteilung rather than Aufhebung for asylum seekers. You do not have to use the form. You can also write a letter with the information. You have to provide three months of payslips from your job to show you are financially self-sufficient.

The potential difficulty I see in your case is the location of your workplace. If you worked in Freiburg and planned to move to another city near it, then as long as you can commute to work from there it would not be a problem.

If your company has an office in Potsdam (or Berlin), or your job is completely in home office, then it can also work. You should provide something from your employer confirming this. Otherwise, the Ausländerbehörde are going to presume you are going to end up in Potsdam without a job and be entitled to benefits from the Sozialamt there. If this did happen, you would be required to move back to Freiburg. But I doubt they will permit you to move in the first place unless in the examples I mentioned above.

Your partner can write a letter to include in the application but the relationship is not relevant in this situation as you are not married. The alternative is to find and work a job in Potsdam for a few months and then request the official move.

You can keep a record yourself of the dates and times the father visits. The only additional evidence I can think of is if there are other people, e.g. friends, neighbours, family members, who see when the father visits and for how long. They could then also confirm as witnesses the detail of the visits.

You recently had a similar question which my colleague answered. I agree with her that contacting the Jugendamt or a family advisory service (Familienberatungsstelle) is a good first step.

Just to add that it is important to distinguish between Sorgerecht and Umgangsrecht. You and the father have shared Sorgerecht which you most commonly see when you both have to sign certain things at the child’s doctor or Kindergarten. The Sorgerecht, therefore, deals more with formal things than the day-to-day care.

The Umgangsrecht is the right and obligation to have regular contact with the child. This is commonly organised on an informal basis between the parents. If one parent does not fulfil their obligations, however, a written agreement on how, where and when the contact should take placed can be drawn up. Again, the organisations referenced can help you with this. If a parent then does not follow the agreement, the other parent can go to the family court and have a court order made that the other parent must follow. But this is a last step and the court encourages parents to try to first resolve any such issues themselves or with the help of a family support service.

If you are not sharing childcare responsibilities, then you are entitled to financial support in place of this from the father. These payments are called ‘Unterhalt’. If the father is unable or refuses to pay what he is required to, you can apply for the payment ‘Unterhaltsvorschuss’ from the Jugendamt.

Getting the Wohnsitzauflage lifted with a chronic illness?

I recently got diagnosed with vasovagal syncope in the emergency room. Its basically losing consciousness in the case of certain triggers and the thing that triggered my vasovagal episode was poor ventilation and being in a crowded area. This didnt happen in my room at the GU but i have been very close to getting episodes before i got diagnosed and in fact fainted in my room once before too. I just didnt know what it was and assumed it was anemia so I didnt think too much of it. Ventilation here is also horrible (in the toilet i can smell the kitchen from the upper floor, and sometimes their toilet its gross and windows dont help much when the inner ventilation is like this. overall its a moldy and clammy flat) and its crowded. Is it possible to get my wohnsitzauflage removed with this? I just have a paper of my diagnosis from the ER and what happened to me that day. Do i need to explain authorities my illness? Thanks

The local "Jugendamt" (youth welfare office) is the right institution to involve here. You can contact the Jugendamt for individual counselling. As a measure of last resort and if it is the best for the children, they may also support you with applying for the sole custody at the family court.

The rules are not the same for people with paragraph 24. Family reunification is only allowed in certain very specific cases. The family members must have become separated due to the war and the family member outside the EU must themselves be in need of protection.

You can read this rule in paragraph 29, section 4 of the Aufenthaltsgesetz (in English via online translation):

In your case it does not apply, as you married after the war started and presumably did not live together in Ukraine before the war.

It is not clear from your question what kind of residence permit you have in mind. If you will be entitled to a residence permit on the basis of your child, then you should apply for this at your immigration office (Ausländerbehörde) before your current visa runs out. You could be entitled to a residence permit on the basis of your child if the child will have German or EU nationality or the other parent has a residence permit. However, in the latter situation you are not automatically entitled to a permit. I would have to know more about your situation.

Applying in time for a permit means your current visa is extended until the immigration office makes a decision on your application. By the time they process your application, the child will be born and you will receive a permit.

If having a child does not entitle you to a residence permit, then you should apply for an extension of your current visa due to the pregnancy. In German, the period of time before and after the birth of a child is called ‘Mutterschutz’. It goes from 6 weeks before the birth to 8 weeks after it. In this time period you cannot be expected to leave Germany and so will get at least an extension for this time. You may get additional extensions to allow you to get a passport for your child.

If you are not entitled to a residence permit, you may be given the extension paper ‘Fiktionsbescheinigung’ or a paper called a ‘Grenzübertrittsbescheinigung’. The type of paper you have is important as it will affect things like your access to health insurance, social welfare etc.

I recommend you make contact with an advisory service for pregnant women. This is called a ‘Schwangerenberatungsstelle’ and they are offered throughout Germany. It is open to everyone, regardless of your immigration situation. It is for free and confidential and usually you can find someone who speaks English.

Lifting the Wohnsitzauflage

I have an Aufenthaltsgestattung and I have proved my identity to the authorities. My mom is doing an Integrationskurs, I did a Berufsprachkurs and now I have a place for a schlusiche Ausbildung. Online it says that I can get the residence requirement lifted, but when I email authorities about it the email I got in return was like "Well you can commute there, so its not needed."
It would be hard for us to manage like that (someone needs to pick my little sibling off ths school, and we all get out at different times)
It also says online that its possible to get it lifted with an Integrationskurs/Sprachkurs? Do different things apply to people who have an Aufenthaltsgestattung

Yes, you can move out of your ‘Gemeinde/ Stadt’ if you are able to financially support yourself. You have to show that you have a regular income that it is more than the amount provided for by asylum seekers’ benefits. You have to make an application with your local Ausländerbehörde to have the obligation to live in a certain place removed. This application is called ‘Antrag auf Aufhebung der Wohnsitzauflage’ and is made in accordance with paragraph 60 of the Asylgesetz. You need to send supporting documentation (job contract, payslips) with the application.

Unfortunately, there is not a lot we can do here about this situation. If you wished to continue living there, then there are places that can help you to asserting your rights as a tenant, such as a tenants’ association or the university’s legal advice service. As you wish to move out, then perhaps the university student support services could help you with this. They may be able to help you to access student accommodation (this is usually called a ‘Studentenwohnheim’) on short notice due to your situation. There you have your own room but may have to share other facilities with a few other students. Until you find something new, I can only recommend you do what you consider to be your fair share of the housework.

People with an Aufenthaltsgestattung can receive Wohngeld.

Kindergeld is only possible for citizens of the following countries who are working:

Turkey, Algeria, Tunisia, Morocco, Bosnia and Herzegovina, Kosovo, Montenegro, and Serbia.

If you receive Wohngeld, you can also receive the benefits of the ‘Bildung-und-Teilhabe’ package. These are additional benefits for children in school. It provides money for the following:

Payments for school materials twice a year

School transport
School meals
Class trips
Participation in sport/culture (e.g. membership fee for a football club or music lessons)
Private school tuition (called ‘Nachhilfe’ or ‘Lernförderung’ , if a teacher confirms a pupil needs this)

You apply for both the Wohngeld and the Bildung-und-Teilhabe supports from your local Sozialamt.

I am sorry to hear about your difficulties. Without to know the first tenant's background and the way the contract between him/her and your husband was closed, I have the feeling that contacting the landlord directly could make things even more complicated for the time being (even though it would be your right). Is it possible that the landlord is not even aware of the sublease agreement between the first tenant and you? I am not an expert in tenancy law at all and I highly recommend you to get some individual support here. I assume a migration counselling office would be a good first contact point for your husband - especially since it is all about family (re-)unification as well. They may also refer him to another counselling servive for tenants if the issue can not be solved.

For my answer, I am assuming your girlfriend has German citizenship.

The situation is different before and after the birth of the child.

Before the birth:

Fathers do have the right to go to Germany already before the birth to be there during the pregnancy and for the birth of their child. This right is not stated clearly in the immigration law but is generally accepted to be possible. For this, it is not sufficient to have the recognition of paternity. You also have to show you have shared custody (Sorgerecht).

If you have shared custody, then you can apply for such a visa in your home country or any other where you have habitual residency. Here is an example of the application process for expectant fathers from the German embassy in Chile. The procedure should be the same in all embassies but not all have such detailed information about it online:

If you travel without a visa, you can apply directly in Germany for a permit on this basis as ‘expectant father of a German child’. However, the authorities only allow this in exceptional cases where it is not reasonable to expect the person to leave Germany in order to go through the visa process. It is possible you may instead be issued with a temporary residence paper to allow you to stay until the birth. It is, however, also possible that you would be ordered to leave the country within a specific deadline. The authorities have some discretion in whether to allow you to stay or not.

After the birth:

You will be father to a German child. As I understand, you have the recognition of paternity but not custody rights. This means you still have access rights as a parent (Umgangsrecht). You have the right to have regular contact with your child. Without shared custody, you are not entitled to a residence permit as the parent of a German child. At most, you can get the temporary status of ‘Duldung’ as long as you have contact with the child. At a later period, you can change to a regular residence permit but this would depends on other requirements being fulfilled. You may at that point also be required to leave Germany to go through the visa process first.

If you do have shared custody, you are entitled to a regular residence permit. You will, however, be asked to first get the required visa. In cases of young children, it is not reasonable to require a parent to leave and go through a lengthy visa process and so the local immigration authority (Ausländerbehörde) should process your application directly. But it is a matter which potentially may need you to go to court. Here is an article which discusses this issue:

Unfortunately I do not know of any way to speed up this process. The Ausländerbehörde in Saarland asks the Ausländerbehörde in NRW to agree to allow you to move.

There is a section of the immigration law (Aufenthaltsgesetz) that sets a time limit for how long the Ausländerbehörde in NRW has to reply. If they do not reply within four weeks, then the Ausländerbehörde in Saarland has to assume they agree and you can move.

This rule is in paragraph 72, section 3 of the Aufenthaltsgesetz (here in English via online translation):

This means that at least if four weeks have passed and you have no answer, you can inquire with the Ausländerbehörde Saarland and point out this rule to them. They then have to issue you with the approval.

The only other option I can think of is if your future employer makes an enquiry and emphasises that they need you to start work by that specific date and cannot wait any longer.

Relocation requests do get rejected. This can be for various reasons. For example:

Wishing to move to do a German course somewhere else when there are German courses available in the current place of residence.
Having a job offer in another place but with not enough hours and which does not cover a person’s living costs.
Wishing to move to join family members who are not core family members (spouse or minor children).

If you have a job offer with at least 15 hours work per week and net income after taxes of at least 800€ a month, then there is no reason to reject your request.

I unfortunately do not know of any other financial supports available to you. Under certain circumstances, you can be issued with a WBS.

It is also up to you as a family to decide how much of your income you are willing to spend on rent, and up to a landlord to decide whether this is reaslistic. There is not a particular limit to how much rent you can pay.

If you still get a little financial support from the Landratsamt or Sozialamt, you can apply for it in one of these offices. If you get no financial support from one of these offices, sometimes it is still possible to get a part of the money, you spend for your initial requirements in your new apartment; of course, if your income is not enough for these requirements. In this case, when you apply for the initial requirements (Erstausstattung) in your respective Landratsamt or Sozialamt, they assess your financial situation and see whether you have the right to get some help from them or not.

In addition, there are some organizations such as DRK/BRK or Caritas, which have Möbelkammer, from where you can buy the second hand furniture for your apartment with very low price.

Last but not least, in some cases, depending on the city, where you live, there are some organizations which have some budget for this. When you refer to them, they will assess your financial situation and after that they might help you with it financially. Please refer to a migration counseling office, such as to Caritas, Diakonie, AWO, BRK/DRK, in the city or region, where you live, and ask them about it, they may give you some good tips about it.

Your child may be able to get a resident permit for Germany. For people with paragraph 25b, it is only possible for them to bring family members for humanitarian reasons. As the child presumably has also a temporary residence permit in Lithuania, then I do not know if the situation can be considered under humanitarian reasons. The father will have to show proof of paternity and custody and you will have to give your permission for the child to move to Germany. Even with all that, I do not know if the application would be successful.

Another requirement is that the person in Germany can cover the living and housing costs for the child. You write, however, that the person has 25b, Abs. 3. That section of 25b refers to people who are unable to fulfil the requirement of being able to financially support themselves due to age, illness or disability. If this applies in the father’s case, then it would equally apply for the child.

There is no rule that I am aware of that states vulnerable people are only eligible to move after a year in a GU. Vulnerable people have to be given the required protection they need from the first day they are in a GU. If this protection cannot be guaranteed, then such a person has to be housed in an apartment.

For example, unaccompanied minor children are not allowed to stay in a GU as it is clear they require extra protection and safer accommodation. They are provided with specialised housing with other unaccompanied minors.

For all other cases, it is the authorities who decide whether a person is sufficiently vulnerable to require then to be housed separately.

The legal text that requires EU countries to have certain standards when housing asylum seekers is the EU’s Reception Directive. Article 21 lists certain cases to be considered as vulnerable and includes minor children and single parents with minor children. Here you can read the legal text itself:

In Germany the law that applies this EU law for accommodation in GUs is section 53 of the law on asylum (Asylgesetz):

It refers to a different section of the law that requires each state in Germany to provide appropriate accommodation to women and vulnerable people and states that this requirement applies also in GUs.

I hope that is not too complicated but I wish to make it very clear that there are laws at EU, national and state level in Germany that require the authorities to act in order to protect vulnerable people. Despite what you have unfortunately been told by staff, such conditions you describe are not ‘just the way things are.’

I recommend you apply in writing to the part of the Sozialamt in charge of accommodation for asylum seekers and ask to be housed in an apartment.

This type of accommodation is called ‘dezentrale Unterbringung’. The apartments are coordinated by the Sozialamt of the area you are in. The apartments are often called ‘Gewährleistungswohnung’ or ‘Belegwohnung’.

You make an application (Antrag) to be housed in an apartment.

That example is written a bit more generally, if you use it you should adapt it to make it clear that this is a case of a vulnerable family and refer to the legal basis I mentioned.

But you do not have to use any particular form. Important is to provide your names, dates of birth and address. You should provide as much detail as you can about the situation in the GU:

How long have you been living there?
Have you been moved within the GU?
What is your room like?
Who have you had to share a room with (not their personal details, just whether they are other families, men, women etc.)?
How are you given privacy in the room and also in any washing facilities?
Have the people who run the GU made any improvements or offered any alternative better accommodation within the GU?
What incidents have taken place where you and your family felt unsafe?

If you wish, you can also mention your medical history but it would be best to do this if you can provide some documentation as proof.

As it is an urgent situation, you should set them a deadline to respond. If they reject your application, you can appeal and also take further legal action.

If the staff in the GU are unwilling to assist you with the application, you can request assistance from a migrant advice service. Here you can search for one in your area:

Unfortunately, asylum seekers (people with a pending asylum case and "Aufenthaltsgestattung") are usually not able to receive a so-called "Wohnberechtigungsschein" (WBS). I am not sure if I fully understand your other question. In general, it can be quite difficult to get the permission to move out from a refugee accomodation into private housing as an asylum seeker (still waiting for the BAMF's decision). It gets even more complicated if people are dependant on social money and need to find accomodation in the set range (the "reasonable" rent which will be covered). Maybe you can specify a bit more about your case.

Ich befürchte, dass ich dir leider keine einfache und klare Antwort auf deine Frage geben kann. Der Paragraph 53 Asylgesetz besagt Folgendes:

(1) Ausländer, die einen Asylantrag gestellt haben und nicht oder nicht mehr verpflichtet sind, in einer Aufnahmeeinrichtung zu wohnen, sollen in der Regel in Gemeinschaftsunterkünften untergebracht werden. Hierbei sind sowohl das öffentliche Interesse als auch Belange des Ausländers zu berücksichtigen.

Soweit ich weiß, variiert der Prozess und der Umgang mit Auszugswünschen von Menschen im Asylverfahren je nach Region/Bundesland. In Bayern müsstet ihr, zum Beispiel, eine "Auszugsgestattung" bei der Regierung von Mittelfranken beantragen. Jeder Fall wird individuell geprüft. Die Tatsache, dass ihr euren Lebensunterhalt selbst sichern könnt, ist sicherlich vorteilhaft. Aber die zuständigen Behörden schauen sich vermutlich eine Reihe von Faktoren an. Du hast Recht: Das Jobcenter dürfte in eurem Fall eigentlich keine Rolle spielen. So lange ihr im Asylverfahren seid, ist das Jobcenter ja gar nicht zuständig für euch. Sobald ihr eine Anerkennung durch das BAMF erhaltet (euer Asylverfahren also positiv beschieden wird), dürftet ihr euch dann auch mit Sicherheit eine eigene Wohnung suchen. Im Falle einer Ablehnung könnte es ebenfalls wieder konpliziert werden.

Ich würde euch empfehlen, euch zunächst an eine Flüchtlings- oder Migrationsberatungsstelle in eurer Nähe zu wenden. Unter Umständen gibt es Projekte, die Geflüchtete bei der Wohnungssuche unterstützen. Die Beratungsstelle könnte euch dann weiter vermitteln. Außerdem kennen die Sozialarbeiter*innen vor Ort die zuständigen Behörden und können euch bezüglich der Erfolgschancen eine bessere Einschätzung geben.

Ich hoffe, dass das wenigstens ein kleines bisschen weiterhilft und kommt doch gerne wieder auf uns zurück, wenn es noch weitere Fragen gibt.

I am not aware of any law/rule you may be able to refer to in this case. However, I also have my doubts that a social worker can decide on this alone. The only idea is to contact the complaint management (Beschwerdeverfahren or Beschwerdemanagement) if there is any available in your accomodation. Your obligation to live in the village has been cancelled for educational reasons. You are not obliged to live in a particular place now.

However, if in the first three months after moving the reason for moving is gone, then the person is obliged to live out the rest of the three years in the new place. Once the three months are over, then there are no more obligations.

For example, a person is living in town A and finds an Ausbildung in town B. They request to move and it is approved. The move there in September but in November they stop the
Ausbildung. They are then obliged to live in town B until the 3 years are up or they find a new reason to move such as a job or course.

The rules on this are in paragraph 12a, section 1 of the Aufenthaltsgesetz:

ich habe 11.07.2013 einen Asylantrag gestellt. meine Asylantrag wurde vom BAmf abgelehnt. ich habe im Anschluss Klage gegen den Bescheid eingereicht und diese am 14.07.2021 zurückgezogen, sodass das Verfahren durch das Verwaltungsgericht München eingestellt wurde. ich wurde von der Ausländerbehorde durchgängig von 2013 bis 2021 eine Aufenthalgestattung erteilt. seit 26.08.2021 bis 18.04 .2023 habe ich 25b abs.1 s.1 gehabt. und dann habe ich für Niederlassungerlsubnis beantragt und 14.06.2023 habe ich meine Niederlassungerlsubnis 26 . Abs.4 per post erhalten.
1. ich habe Hauptschulabschluss
2. intergrationkurs absolviert
3. B2 Zertifikat aber nur Modul sprechen bestanden.
4. Ausbildung als Pflegefachhelfer absolviert.
5. ich arbeite Vollzeit mit unbefristet Arbeitsvertrag seit 2017.
