Answered: Ausbildungsduldung with a 2 year Helfer Ausbildung?

In my view it would be possible to get an Ausbildungsduldung with this, but with additional conditions.

I have looked over the description of the Ausbildung and it seems to be a standard Altenpflegehelferin Ausbildung but with additional German lessons and a course on Staatsbürgerkunde (about German history, politics and society). This is why it takes two years instead of the usual one year for a standard Altenpflegehelferin Ausbildng.

Because it is a Helfer-Ausbildung, there are additional requirements. It must be in a sector where Germany is in acute need of workers. The term in German for this is ‚Engpassberuf‘. Care work such as Altenpflegehelferin is such a profession where workers are needed.

Your relative also requires an offer of a full Ausbildung place after doing the Helfer one. It is not possible to get an Ausbildungsduldung for a Helfer-Ausbildung unless there is the promise that the person can continue learning after it with a full Ausbildung. The most obvious Ausbildung to continue with would be as ‚Altenpflegerin‘ but there may be others in the healthcare sector that could suit. Your relative must therefore ask her employer to provide an offer for a subsequent Ausbildung providing she completes the Helfer-Ausbildung. This offer is called an ‚Ausbildungsplatzzusage‘.

I'm afraid that we can't judge from afar whether or when the so-called ‘transfer deadline’ will expire. Normally, the transfer period runs for 6 months from the date of approval by the responsible EU member state (in your case France). In some cases, however, the deadline is extended (12-18 months). Especially if the authorities assume that the person concerned has absconded (in practice, this extension happens again and again, although the asylum seeker has not absconded at all). Did the BAMF's negative decision really only come in May 2025 or already in 2024? Actually, the BAMF also states when the deadline expires - but I think that this is often difficult to filter out from the documents. I would strongly recommend that you ask a counselling centre for support (the asylum procedure counselling centre would be the best place to go - the "Asylverfahrensberatung"/AVB). The counsellors can also ask the BAMF about the deadline so that you get reliable information in the end. You may use this search engine to find contact details of counselling services in your area.

In paragraph 19d (2) German Residence Act it says: "After two years of employment corresponding to the professional qualification, the residence permit entitles the holder to any employment".

As I understand it, the cancellation of the restriction to a specific job is therefore not optional, but the rule after 2 years - when the residence permit is extended. The residence permit will be extended if the requirements for its issue continue to be met. The residence permit includes a work permit for any type of employment if you have worked for two years in accordance with your training qualification. As I understand it, the immigration authority will now check after two years whether the conditions for issuing the permit are still met. If they then extend your permit, you no longer have to work in accordance with your qualification.

Would you agree with this dear @mbeon-fardeen or @mbeon-Éanna?

Mit einer Aufenthaltsgestattung (also während des Asylverfahrens) kann man tatsächlich in der Regel kein Bafög bekommen. Allerdings erhältst du ja Asylbewerberleistungen, oder? Ich verstehe allerdings, dass zusätzliche Kosten (wie Gebühren für die Schule) damit kaum bezahlt werden können - das Geld ist ja eh schon sehr wenig. Ich würde dir empfehlen, dass du dich beim Jugendmigrationsdienst beraten lässt. Zusammen könnt ihr schauen, welche Möglichkeiten es in deinem Fall vielleicht geben könnte ( beispielsweise ein Stipendium, Programme der Schule für Geflüchtete oder ähnliches).

Eine Ausbildungsduldung kannst du derzeit nicht bekommen. Eine Duldung erhältst du erst, wenn das Asylverfahren abgelehnt wurde und du eigentlich Deutschland verlassen musst. Falls dies ohnehin passiert, könntest du natürlich schauen, ob eine Ausbildungsduldung in Frage kommt. Auch hier kann die Beratungsstelle (wie z.B. der Jugendmigrationsdienst/JMD) gut unterstützen. Auf der verlinkten Webseite findest du die Kontaktdaten von JMD-Stellen in deiner Nähe.

Yes, single parents can do an Ausbildung in Germany. The statement from this ‘Ausbildung agent’ is not true. It can of course be more challenging for single parents to manage to do an Ausbildung but people certainly do. Generally, some extra flexibility around working hours is required but there are also part-time Ausbildung which can be a better option for single parents. Here’s some good information about the challenges and supports there are in Germany as a single parent doing an Ausbildung (in English via online translation):

As I mentioned in my answer to your other question, it may be an option to bring your child with you, if you don’t plan to based on the level of your salary. There are the additional state benefits for families and single parents that may be sufficient to cover both of your living costs in Germany.

The only issue I can imagine in the visa process if your child does not come with you is regarding how your child will be supported while you are in Germany. The German immigration authorities generally **** at a person’s requirement to pay child support when assessing if they have enough income to live in Germany. But I am only aware of this being a factor when, for example, a person has a child in Germany and is required to pay the other parent child support because they are not loving together. I have not heard of this being an issue if their child is not in Germany.

I will try to answer some of your questions, but in general I would highly recommend you to get some individual counselling in a migration counselling office to elaborate on your options and the next steps to take. In Berlin you find numerous well experienced, free of charge and confidential counselling services. You may use this search engine to find the respective contact details.

If I see it correctly, my colleague was also providing information on some of your questions in one of your earlier opened threads here. Maybe you want to check his answer again (especially in light of your first and third question).

If you want to move to study, you have to submit an application to change the residence requirement (Wohnsitzauflage) at the immigration office. As far as I know, they will also involve the immigration office at the place where you want to move.

Regarding your status: Unfortunately, it will not change just because you are enrolled at the university. I am not a lawyer, but as far as I know, you would need to re-enter with the respective visa in order to get the residence permit according to section 16b of the German Residence Act (for students). Generally speaking though, the better you are qualified and integrate yourself in Germany, the better your prospects for residency will be in the long-run.

As far as I know, you may be able to receive Bafög now, since you are in Germany for more than 15 months (which is the minimum to be eligible).

I would really discuss with an expert in a migration counselling office whether it makes sense for you personally to switch to a training occupation (making an Ausblildung). This depends on many factors.

Yes, you can do this. As part of the visa process for family reunification the authorities will then ask why you are only at that point applying for reunification and will wish to see evidence of how you maintained contact with your child while you were in Germany. They will also require proof that you have sole custody of the child.

You may be able to bring your child to Germany with you as a family member while doing the Ausbildung, if this is a consideration for you. You will be entitled to child benefit (Kindergeld) of 250€ as well as an allowance for single parents (Unterhaltsvorschuss) of 227€ per month. Depending on your situation, you may be entitled to additional benefits such as extra child benefit (Kinderzuschlag) and rent supplement (Wohngeld). Having proof of sufficient income is an important requirement if you wish to have your child also receive a visa.

Yes, this does concern the Ausländerbehörde. You need to inform the Ausländerbehörde that you are changing course and university. You do not need to apply for a new permit.

The authorities have discretion in whether to allow you to continue studying or not. You have a visa permit according to paragraph 16b of the immigration law (Aufenthaltsgesetz):

Section 2 covers how long the permit is to be issued and whether it should be extended or not. The key part states that it can be extended if the purpose of the study has not yet been achieved and can be achieved in a reasonable amount of time.

In your situation the key factors would be questions such as: how were your marks at university over the 6 semester so far? Would you have been able to continue that degree course without issue? Is the new degree program related to the first one or in a completely different field? What are the reasons you wish to change course?

If the authorities feel it is credible for you to start a new degree program and you continue to fulfil the other requirements such as having enough money, then they can extend your visa next week for the new course. On the other hand, if they feel you cannot achieve the purpose of your study visa in a reasonable amount of time, then they can cancel your visa. It is at the discretion of the authorities. I recommend you to provide a through account of your situation when informing them of the planned change.

First of all, I am sorry to hear about your rejection. I am not a lawyer, but I am afraid that it will be difficult to get issued a Duldung based on/because of your studies (whether you might have another reason to get issued a Duldung will be checked and depends on your individual situation). At the end it is at the discretion of the immigraiton office. We discussed a very similar question here.

The fact that you are holding a Greek residence permit probably doesn't help here. Exept that you might be able to apply (if meeting the respective requirements) for a corresponding visa for Germany for study purposes in Greece (apart from your country of origin). My colleague explained this here in one of your earlier opened threads as well.

Or do you assess the situation differently dear @mbeon-fardeen or @mbeon-Éanna?

Hi everyone,

I’m an international student currently pursuing my Master’s in Logistics and Supply Chain Management at Technische Universität Darmstadt. I’m facing an issue with my residence permit extension and would appreciate any advice or guidance.

Here’s my situation:

    •    I arrived in Germany late (after my 4th semester) due to delays caused by the COVID-19 pandemic and long processing times at the German Embassy in Dhaka, Bangladesh.
    •    I have completed 21 credits and 9 additional credits this semester, and I plan to complete 30 credits in the upcoming Winter semester 2024/25.
    •    The Ausländerbehörde has not explicitly asked for the Bestätigung der Bildungseinrichtung ( Document provides study prognosis), but I wanted to ensure all documentation was in order, so I requested it from my university.
    •    However, the document from my university has two sections unfilled:
    •    IIIa (whether my studies have been completed properly so far), which was marked as “K.A.” (Keine Angabe, meaning no information).
    •    IIIb, which requires a statement from my department.

I’m concerned that these unfilled sections might cause problems with my visa extension. My residence permit is set to expire on 24th October 2024, and I want to ensure I have all the necessary documentation.

Has anyone faced a similar issue with an incomplete Bestätigung der Bildungseinrichtung? How can I ensure that the Ausländerbehörde will accept the document, or is there any way to resolve this before my permit expires?

Answered: Duales Studium after Ausbildung

If your asylum application is rejected, you can continue the Ausbildung with Ausbildungsduldung/16g. When you have completed it, you would usually change to the permit 19d. 19d is for people with a Duldung and a qualification and is importantly ‘for the purpose of employment’ (zum Zweck der Beschäftigung). You can only get 19d if at least your principal reason for staying in Germany is for employment.

I’m not an expert on the area of Duales Studium but from what I have read there are different types. One is a study programme with integrated Ausbildung and the other is a study programme with integrated work experience. In my view, in either case you are primarily a student, even if you are working as part of it. The name of it is Duales Studium, i.e. first and foremost are the studies, rather than it being called Duale Arbeit or such. If someone from abroad wishes to come to Germany to do a Duales Studium, they have to apply for a visa for study purposes and not for work. You can see this in a detailed brochure here in German and English produced by the state of Saxony:

The only alternative I see is to study part-time. i.e. you work in the area your qualified in and earn enough to get 19d, and in your free time are free to do further studies or qualifications.

The only difference I see that having a valid Greek residence permit makes is to do with the visa process. If you wish to receive a student residence permit, you will have to withdraw your asylum claim. You will then be told to leave Germany and apply for a student visa. As you have valid residency in Greece, you can go and apply for the visa at the German embassy there.

In addition, for a student residence permit you will have to show you have enough money to cover your living costs during your studies. If you remain in the asylum process and study, then you can generally continue to receive asylum seekers benefits. This, however, is at the discretion of the Sozialamt.

Since the Covid-Pandemic it is indeed more common to work remotely and employers seem nowadays to be more flexible in this regard than a few years ago.

Typical jobs which are often conducted (partly) remote are for instance:

Programming
Web design
Accounting
Virtual Assistance
Online Marketing
Texting
Translation
Coaching and Advive
IT-Support
Content Management etc.

At job platforms (indeed, stepstone etc.) you can usually specify the possibility of working remotely as a criterion and thus filter the job offers accordingly. Maybe it is also conceivable for you to go to the office/work place for 1 or 2 days per week and otherwise work from home. Then it will probably be even easier to find something suitable.

Your son is currently at stage two of DaZ classes. While stages one and two can be completed in a year, some school pupils need longer to get to stage three, where they are fully integrated in the school lessons and only receive additional German tuition if necessary.

You refer to a school director and a school principal. This is generally just one role, known as Schulleiter or Schulleiterin. The Schulamt will base their decision on what his teacher and/or school principal feel is appropriate so I do not understand why their recommendations were disregarded.

You should have consultations about your son’s progress called Bildungsberatung with the school over the course of the DaZ classes. His teacher should discuss together with you and your son about how he’s doing with the language and when he can move to stage three of DaZ.

Your son is at secondary school level. The Schulamt does not assign a particular school to him. At primary school level, it is determined according to what school district. At secondary, you are free to apply to the schools that your son would like to go to, as long as he fulfils the requirements (i.e. the recommendation ‘Bildungsempfehlung’ for the Gymnasium if he wishes to go to one). You do not have to wait until the end of school year. For example, if someone moves to a new city during a school year, they also have to apply at a school of their choice and are not assigned one by the Schulamt.

For young migrants between the ages of 12-27 there are youth migration advisory services (JMD – Jugendmigrationsdienste) throughout Germany. They have experience in dealing with schools. Here you can **** for one:

You say that his grades are good. If, however, his German language ability still needs to improve, then you could organise some extra tuition (in German ‘Nachhilfe’) for him. Depending on your financial situation, this tuition can be paid for by the Jobcenter or Sozialamt.

Please note that school education in Germany is a state matter. Each state can regulate things like DaZ slightly differently, although the information I have provided should be more or less the same throughout Germany.

Even holding an "Aufenthaltsgestattung" (during a pending asylum procedure) or with a Duldung, students may be insured in the compulsory insurance for students (like all students; § 5 Para. 1 No.9 SGB V) - usually up to the 30th birthday. Is the problem here that you are older than 30 years old? Unfortunately, I am not an expert in this field. But I highly recommend you to get help in a counselling office - maybe there are also support structures at the university itself? In the worst case you may have to accept a job which is not an official student job - but this dilemma should be solveable anyway.

I will also link my colleagues dear @mbeon-Éanna and @mbeon-fardeen here. Maybe they can add some advice/information.

Even if your asylum case is still pending, you can enrol in a (Master) study program in Germany. German universities have low or don't charge tuition fees at all. This also applies for asylum seekers! Please see this website also for more information.

However, you may not receive financial student support (Bafög) as long as you are not recognised (for rejected people: they might be eligible after 15 months in Germany). For the time being, you will continue to receive your asylum seeker benefits (Asylbewerberleistungen).

I understand very well that the questions in your mind can be puzzling and overwhelming for the time being. However, there are counselling offices which are specialised in supporting young people on exactly these kind of issues (free of charge and confidential). They are called "Youth Migration Services (JMD)" and I highly recommend you to get in touch with them. Here you can find out about such a service near you.

It is a bit difficult to give tailored advice without knowing your individual situation well. I just wanted to comment that you are still very young and in a normal age for making the "Abitur". There are also options to get financial support if you want to study. Handbook Germany explain about the "Bafög" well.

I actually didn't know this programme but found their website which provides some information. You are talking about this, right (they give details in various languages)?

If I understand correctly, the programme is not a qualified "Ausbildung" in that sense but they state that it includes:

Preparation for nursing assistant or nursing assistant training (including nursing, language, secondary school lessons and qualification as a caregiver in accordance with Section 53b SGB XI)
authentic insight into nursing through early nursing and care internships
Graduates meet the entry requirements for nursing training and can optionally continue with it

Whether it can qualify for the one year "Ausbildung" you may complete before entering the qualified (2 years +) "Ausbildung" and already receive i.e. an "Ausbildungsduldung" for it, I can not say for sure (we discussed this topic in a thread you opened before). I recommend to get in contact with the programme management for individual advice and get some support in a counselling office in this as well.

My colleague Éanna answered a very similar question here before and explained:

"It is possible to change from a student visa to a work visa, even if you drop out of university. The German government changed the regulations on such cases as part of a law it passed called the Fachkräfteeinwanderungsgesetz in 2020.

Please bear in mind that a work visa can only be issued for job that require a qualification, generally a university degree or formal vocational training (Ausbildung). If you have a foreign qualification, it may need to be recognised. For some nationalities there are exceptions to this rule."

Welcome back to the Wefugees Community and thank you for your question about the recently introduced residence permit for vocational training (according to §16g of the German Residence Act).

Handbook Germany just published information on this type of residence permit in various languages which give a good overview.

They state:

You can obtain a residence permit for vocational training if you have been in Germany:

either for at least three months under Section 60a of the Residence Act

or are an asylum seeker, and your asylum application was rejected during your vocational training,

And also:

you started qualified vocational training in a state-recognised or similarly regulated vocational training,

or
you started training for an assistant or helper position (“Assistenz- oder Helfer*innenausbildung”) in a state-recognised or similarly regulated training programme and then started professional vocational training (“Berufsausbildung”).

Please follow the above posted link for more details.

This residence permit also allows you to travel abroad - of yourse you need to comply with the visa regulations of the respective country (in your case Iran).

Welcome back to the Wefugees Community and thank you for reaching out to us again.

As far as I know, the one year vocational training ("Ausbildung") is the assistant training and not recognised as qualified "Ausbildung" as such (so it would be always better to make a 2 years or 3 years Ausbildung, if possible). However, the one year training might be a good option to enter the field in the first place and you can also continue your training afterwards. In case you want to apply, for instance, for an "Ausbildungsduldung" (which is ususally issued for people who do a minimum 2 years Ausbildung) after the rejection of your asylum application, you can also obtain an "Ausbildungsduldung" for the specific one-year-long assistant training courses, given you meet the following requirements:

You must have secured a spot in a qualified two-year-long training programme following your one-year of training.
The profession for which you are training is a so-called "Mengelberuf" which is in high demand, such as professions in the care sector. (for more Information, please see Handbook Germany)

Please note, that there is also an option now to get a residence permit according to section 16g of the German Residence Act for people who were in a "Duldung" (tolerated stay after i.e. a rejected asylum procedure) and who make an Ausbildung.

In genereal, as I explained in my last answer, nursing/caring staff is always wanted in Germany and you will have good chances to secure your stay if you are qualified in this field. However, I would never recommend to opt for this job only for residence/strategic purposes as it is important that you like the job as well and willing to do it for at least several years.

The information from the Agentur für Arbeit is incorrect. As I understand it, you have the residence paper ‘Aufenthaltsgestattung’ and are therefore allowed to work with the permission of the Ausländerbehörde.

You are entitled to register as a job-seeker (arbeitssuchend) with the Agentur für Arbeit and they have to assist you in finding an Ausbildung. They can pay for your diploma to be translated. They can also pay for the cost of having your diploma recognised here in Germany.

This is the office responsible for the recognition of foreign school certificates in Baden-Württenberg and here the process is explained in English:

I encourage you to contact them again and point out that you are entitled to their assistance. The specific type of help you are looking for is from what is called the ‘Vermittlungsbudget’. This is money that the Agentur für Arbeit can use to spend on supporting people to find a job or Ausbildung. This includes costs of translations and recognition of diplomas, and also such things as getting professional applications prepared and the costs of travelling to interviews. I just answered your other question on this topic. To confirm again, a 'duales Studium' also entitles you to get an Ausbildungsduldung or resident permit 16g, if it leads to you having a vocational qualification (Berufsabschluss) in addition to a third-level academic qualification.

It depends what type of Ausbildung it is. There are two types, one where you just learn at a school (schulische Ausbildung) and one where you learn at a school and also work at a company (duale Ausbildung). The first type is not considered work so you not need permission to do this. The second type is considered work and so you cannot begin this without the permission of the Ausländerbehörde.

It is not clear from your question what exactly you have applied for from the Ausländerbehörde. If you have the status ‘Ausreisepflichtig’, then you cannot receive a work permission to do an Ausbildung. You first need to have the temporary status of Duldung. If you have not done so, I recommend you apply for a Duldung together with permission to work and provide information and proof about the Ausbuildung. Under certain circumstances, you may at a later point be able to change to the more secure status of ‘Ausbildungsduldung’ or residence permit 16g.

Generally speaking, parents can receive Kindergeld (child benefit) for children between 18 and 25y. if they are in their first "Ausbildung" (incl.), school or study programme as well as in their second "Ausbildung"/school/study programme and work for up to 20h/week. This website explanis the conditions quite well.

If I remember correctly, however, you and your parents are still in the asylum procedure, right?

Unfortunately, asylum seekers (pending procedure) and rejected asylum seekers (with Duldung) are not eligible for Kindergeld.

Welcome back to the Wefugees Community and thank you for being such an active member.

Making an "Ausbildung" is a very good idea and in general, it is also possible to do it part-time. For this, you have to find an employer/training company (you want to make a dual vocational training including working with an employer and going to school, right?) which agrees on the part-time model. However, I have some doubts if changing the employer and school after a few months again (in case you move to another place) makes much sense. Do you know already where you are going to move? If yes, I may recommend to apply for an "Ausbildung" at the new place since the training programmes ususally start in August/September and now would be the time to apply respectively. An Ausbildung usually requires a German level of minimum B1 - you could use the free time to work on this as well.

In case you want to stay at your current location, an Ausbildung might be a reason not to be transferred to another place. I highly recommend to discuss your best options individually with a migration/refugee counselling office.

Yes, you can now apply for the residence permit 16g. The main differences in the requirements for this permit and the Ausbildungsduldung are that for 16g:

You have to show you have enough money to support yourself. However, it is possible to apply for the benefit BAB (Berufsausbildungsbeihilfe) from the Agentur für Arbeit. If this is not enough, you can get the benefit Bürgergeld additionally from the Jobcenter.
You must have a passport, or show that you have made all attempts to try to obtain one.

I do not understand why if you receive 100€ child support, you then receive 350€ less benefits from the Sozialamt. The Sozialamt must have issued you with a detailed calculation of how much you are entitled to. You should check this and if there is no clear reason for the additional 250€ cut in benefits (e.g. you have another source of income such as from work), then you should appeal their calculations.

If you are doing an integration course, then you can apply to BAMF for an allowance for your travel costs. This is only possible if your school is more than 3 kilometres from your home. Here this is explained on page 4 in English:

If it is not an integration course, then the only option I can think of is to apply for the travel costs to be covered under ‘other benefits’. The law covering benefits for asylum seekers is called the Asylbewerberleistungsgesetz. Under paragraph 6, the Sozialamt can in special circumstances provide extra benefits.

It states such extra benefits must be essential for a person’s livelihood or health. I doubt that travel costs to take part in a language course would be seen as such an essential need but you can make an application. If you do, then you need to make a detailed argument about how much the travel costs are, how you have no other transports possibilities, how it is affecting your attendance and ability to learn German etc.

This is not really my area of expertise but I have looked into it a little. From what I can tell, in certain professions it is possible to do a bachelor degree in a shorter time due to having an Ausbildung in that field.

However, I have only found this offered by private universities where the fees for attending are much higher. Here for example is a third-level institution in Frankfurt where a person can do a bachelor in computer science in 5 semesters if they have an Ausbildung in that area:

Yes, you can make an appointment with your local Agentur für Arbeit and request a Bildungsgutschein. There are not specific cases where a person is entitled to one. The staff at the Agentur **** at each case individually and assess whether it makes sense for them to finance someone to do a particular course.

They will **** at factors such as the person’s prior qualifications and experience, whether they speak enough German to do the course, and how the job market is for people with the type of qualification you wish to do.

They can provide it for people who are working yes. However, it may be more difficult to convince them that you need the Bildungsgutschein when you are already working fulltime and are able to support yourself without state benefits. They will also want to know how you propose to complete the course when you are working fulltime. It is important that you approach the request for the Bildungsgutschein a bit like a job interview. You have to convince the staff member that it is worthwhile to finance you to do the course.

Yes you can switch Ausbildung if you get a new contract.
I recommend you inform them as soon as you have a new contract. The conditions of the Ausbildung have to be checked by the Agentur für Arbeit before the Ausläbnderbehörde can approve it. The Ausländerbehörde will presumably have to change the expiry date of the permit as the new Ausbildung will finish at a later date to your current one. If you wait to inform them on the day you go to get your permit, there is a possibility they will not give it to you as it is based on your contract as Pflegefachkraft.

As you say the Sozialamt is paying your health insurance, are you an asylum seeker? If so, you cannot receive assistance from the Jobcenter. You can register as a job seeker with the Agentur für Arbeit and ask them to fund the course. You need an education voucher (Bildungsgutschein) from the Agentur für Arbeit to pay the cost of the course.

The DCI states on its website that they accept the Bildungsgutschein from the Agentur für Arbeit or the Jobcenter.

If you are not an asylum seeker, then I do not understand why the Sozialamt is paying for your health insurance. Firstly, it generally for people who are retired or unable to work. Secondly, if the Jobcenter says you earn enough as a family to pay your own health insurance then the same rule should apply with the Sozialamt.

If you are able to work and not an asylum-seeker, the Jobcenter is responsible. Even if a person or family have enough income to pay their other costs but cannot afford the health insurance contributions, then the Jobcenter has to cover this cost.

No, having an Ausbildung will not allow you to join university level studies at a later point, e.g. in the second or third year.

The rules for studying with an Ausbildung vary from state to state in Germany. In some states you require some years of work experience after completing the Ausbildung. In others you have to do an entrance exam.

Hi, Context: I am 18M and my origin is Pakistan but living in Middle East from childhood. I am right now in 12th class which is Higher Secondary School-II of Pre-engineering. I get good grades, like I got 91% in 10th.

She should first have her school certificates from Sweden recognised. There are offices for this in each federal state of Germany. If you let me know which state she lives in, I can find out which office is responsible.

As she is 19, she is no longer able to attend regular German schools. There are, however, many options for adults to complete their secondary education in Germany. If she completed the 11^th grade, then presumably she would be assessed as having reached the level equivalent to a German ‘Realschulabschluss’. This is given after ten years of school education in Germany. With this she can then apply to do an adult education course to complete her education to the level of ‘Abitur’, which is the highest German school leaving certificate and is used for admittance to university.

Throughout Germany, there are adult education schools which offer the chance to do the Abitur. These are commonly called ‘Abendschule / Abendgymnasium / Berufschule / Kolleg’. Some offer the course only in the evening, some are only for people who are working. Again, if I know the part of Germany she is in I can **** for the suitable local one for her.

In addition to having her education from Sweden recognised, she will also have to speak German to a certain level in order to take the course. The most common way to do this is via an integration course. Here is more about it:

I tried to do them at the same time, but four months down the line I quit the bachelors because I so behind with my university work load that I just ended up deciding to focus solely on completely the Ausbildung first. The Ausbildung Berufsschule is not as easy as i thought it was going to be plus I was always so tired after an 8 hour workday. I am now about to write my zwischen Prüfung für the Ausbildung and I don’t regret my decision :) times goes by really quick.

The Bachelor of Law is actually not an "Ausbildung" in a sense how we understand an Ausbildung in Germany (apprenticeship). The "Ausbildung" is rather a vocational training programme which usually includes both: Working i.e. in a company and going to a vocational school. After successfully finishing a bachelor programme, however, you will obtain a university degree.

Every university programme has its own requirements and specifications. You may check the "Hochschulkompass" and "Uni Assist" for your research.

I presume you are from a non-EU country and studying for a semester in Germany as part of the Erasmus programme. What type of visa do you have? There should be reference to a certain paragraph of the residency law on your visa, for example §16b or §16c Aufenthaltsgesetz.

I cannot say with certainty based on the information you have provided. However, if you have a long-term visa (i.e. not a Schengen visa), it is generally possible to change or extend your residence status without having to leave Germany. This is covered in paragraph 41 of the Aufenthaltsverordnung, here via online translation:

If you are holding an "Aufenthaltsgestattung" (during the asylum procedure) or a "Duldung" (after a rejection) you have to apply at the authorities (usually the immigration office/Ausländerbehörde) if you want to move to another place than the municipality you are supposed to stay. For this, as far as I know, you have to submit a so-called "Umverteilungsantrag" in which you give good reasons/proof for your request. I believe that this process usually takes quite long and I have my doubts that you manage it within the next few weeks.

Maybe it is an option to continue school until you finished the process successfully? Maybe you can also find an "Ausbildung" (apprenticeship) without moving?

I highly recommend you to discuss your individual situation and your options at a so-called "Jugendmigrationsdienst (JMD)" office in your area. The social workers are specialised on this type of questions/topics and can support you.

Unfortunately, I am not an expert on this topic but I tried to make some research. You are currently holding a residence permit according to section 16f of the German Residence Act for doing a language course, right? For an "Ausbildung" (vocational training/apprenticeship) you need to apply for a residence permit according to section 16a. According to this table (by the GGUA in Münster) a change between these residence permits should be possible (if you meet the requirements of the 16a) after you successfully finished your language course. However, the final decision is always at the discretion of the immigration office (Ausländerbehörde).

I would recommend you to contact the immigration office directly in order to get some reliable information.

Recognition of foreign certificates

I’m an unaccompanied 16 year old asylum seeker who has applied for asylum in Germany, I currently reside in passau In a Berufsschule. I’m finishing my first year in the Berufsschule in a week and I have to do another year with Praktikum.

My asylum case is still pending.

Before In Iraq I attended a British international school from grade 8-10 and before in a Turkish international school from grades 1-7.

My question is, how can I recognize my Schulabschluss and certificates from Iraq in Germany, does them being British international certificates matter? How long would it take for recognition ?Can I leave the Berufsschule and directly go into ausbuldung or Abitur?My case is incredibly complex .
