As long as you are still doing the Ausbildung in the Autumn of 2028, then the remark on your Aufenthaltsgestattung should be extended. If you do not complete it by 30.09.28, then they will need to see proof that you are still enrolled on the course.&lt;br /&gt;
&lt;br /&gt;
What I don’t fully understand is why you have a remark on your Aufenthaltsgestattung about the Ausbildung. Are you doing a ‘duale Ausbildung’, i.e. working at a company part of the time and in school the rest of the time? In Germany, physiotherapy is usually offered solely as a school-based ‘schulische Ausbildung’. For a schulische Ausbildung there is no permission needed from the Ausländerbehörde.&lt;br /&gt;

&lt;p&gt;I am not aware of parts of Germany where there are two separate authorities responsible for naturalisation. To my knowledge, there is one office called something like ‘Einbürgerungsbehörde’ or ‘Einbürgerungsabteilung’ which is part of the local administration, usually as part of the immigration office (Ausländerbehörde).&lt;/p&gt;

&lt;p&gt;If there are two such offices, then the only reason I can think of is that they are responsible for different types of naturalisation, for example:&lt;/p&gt;

&lt;ul&gt;

&lt;li&gt;As a foreigner who has lived 5 years in Germany&lt;/li&gt;

&lt;li&gt;As a spouse of a German citizen&lt;/li&gt;

&lt;li&gt;As a descendant of a person with German citizenship ‘durch Abstammung’&lt;/li&gt;&lt;/ul&gt;

&lt;p&gt;It would make little sense to have two separate authorities or parts of the local administration responsible for exactly the same procedure. If you wish me to **** at the procedure in the specific area you are in, I am happy to do so.&lt;/p&gt;

&lt;p&gt;The time it takes for naturalisation is on the one hand based on the number of people applying in that particular area but also on the specifics of each individual case.&lt;/p&gt;

&lt;p&gt;We cannot provide legal advice here and so I cannot say what your chances of being successful with an appeal are, besides not knowing the details of your situation. I can say, however, that some of the information you provide is not relevant to an appeal, i.e. that you children are going to school or that your wife is doing an Ausbildung.&lt;/p&gt;

&lt;p&gt;What is relevant is solely the grounds you gave for asylum and whether the court would view these as sufficient to provide you with some sort of refugee protection. The one aspect you mention that may play a role is that your child is undergoing medical treatment in Germany. If such medical treatment is not available in your home country, then this may be grounds for receiving the protection status ‚deportation ban‘ (Abschiebeverbot). If this condition was already present, then BAMF in its initial decision and the court must have already previously assessed this.&lt;/p&gt;

&lt;p&gt;If you do not appeal or your appeal is rejected, then your wife can receive a special type of Duldung due to her Ausbildung called an Ausbildungsduldung. This does not automatically give you and the children the right to stay in Germany but I would expect the immigration office to issue you and the children with a regular Duldung while she is still doing it. If she successfully completes it, then she can receive a regular residence permit, alongside you and the children as family members.&lt;/p&gt;

&lt;p&gt;I am not an expert in the area of deportation but the basic procedure is as follows: If your case is finally rejected, then you are given a deadline to leave the country voluntarily. The deadline is between 7 and 30 days. Otherwise a deportation can take place. This notification is called an ‚Abschiebungsandrohung‘. You are not notified of an actual planned deportation.&lt;/p&gt;

&lt;p&gt;In case of a final rejection, then your wife must make an application for an Ausbildungsduldung, and for you and the children a Duldung. In the application for you and your children, you should give her Ausbildung and your child’s medical treatment as grounds for a Duldung.&lt;/p&gt;

&lt;p&gt;As you have been involved in court proceedings, then I assume you have a lawyer. Our advice here cannot replace legal advice form a lawyer who knows your case in detail.&lt;/p&gt;

&lt;p&gt;I’m not sure if your situation has been resolved by now but I wish to provide an answer in any case. Yes, after three months without any response or action on the part of the immigration office, you can file a lawsuit of inactivity (Untätigkeitsklage) with the local administrative court (Verwaltungsgericht).&lt;/p&gt;

&lt;p&gt;As we are not lawyers on this platform we cannot advise as to whether this is the best course of action. If you wish to file a lawsuit, then you should get legal advice beforehand. A lawsuit, however, will also take time and cost money. Have you tried contacting an organisation that provide free assitance to migrants such as a refugee social worker that provides support in your asylum housing or a migrant advisory service (Migrationsberatung&amp;nbsp; - MBE)?&lt;/p&gt;

&lt;p&gt;The only possible issue I can see at present in your case is that you are still living in asylum accommodation. This cannot be held against you, however, as you have requested to move and your partner has confirmed you are caring for your child. Strictly sparking, the permit § 28 is for parents who have shared custody (gemeinsames Sorgerecht) but can also be issued to parents who do not have this.&lt;/p&gt;

&lt;p&gt;For the resident permit as a parent to a German child you do not require any level of German.&lt;/p&gt;

&lt;p&gt;I do not see any reason why your application should need to take any longer so yes you can send them a reminder message. If for some reason there are additional questions on your application for § 28, you could for now make a separate application based on your current Aufenthaltsgestattung to move in with your girlfriend and child. This application is called ‚Änderung der Wohnsitzauflage‘ and is accepted to allow family members to live together. This would provide additional proof of your relationship with your child if necessary, although the fact that you have confirmation from the mother of how you are caring for your child then this is already sufficient.&lt;/p&gt;

&lt;p&gt;You cannot register in Jade if you do not have permission from the Ausländerbehörde in Celle to do so. I do not understand why you could receive a potential penalty of 1000€ if a registration is not possible for you. You write that the Landkreis in Jade sent you a letter but that could mean the office in charge of registering people living there (Meldeamt). As I understand it Jade is not a Landkreis but a smaller area called a Gemeinde in the Landkreis of Wesermarsch.&lt;/p&gt;

&lt;p&gt;The Meldeamt can issues fines of up to 1000 euro if a person does not register the address they are living at within two weeks of moving in. Before issuing a fine they must give you the opportunity to explain yourself in writing and even if a fine is issued, it is generally a smaller amount (i.e. less than 100 euros).&lt;/p&gt;

&lt;p&gt;I don’t know why you were turned down to move previously. But you now have a daughter living in Jade. I therefore recommend you apply for a move on family reasons by sending proof of the family relationship along with your application. In the meantime, you inform the Landkreis that you are not permitted to register and you must wait for permission.&lt;/p&gt;

&lt;p&gt;Based on your account of your friend’s situation, I can only think of the following possible grounds for the review of her subsidiary protection:&lt;/p&gt;

&lt;li&gt;If she applied for or renewed her passport from her home country.&lt;/li&gt;

&lt;li&gt;She was a minor under 18 years of age when she received the protection.&lt;/li&gt;

&lt;li&gt;She received the protection status by making false claims or using falsified documents.&lt;/li&gt;

&lt;li&gt;The conditions in her home country that led her to receiving subsidiary protection have changed. The change must be significant and not just of a temporary nature. It is BAMF’s obligation, rather than your friend’s, to prove that such a substantial and lasting change has taken place.&lt;/li&gt;&lt;/ul&gt;

&lt;p&gt;As part of the procedure, she must be informed both that a review of her protection is underway and also the reasons for this. This is in accordance with an EU directive on granting and withdrawing international protection. It is in article 45, section 1, part (a) of this directive:&lt;/p&gt;

&lt;p&gt;An interview is generally required if she received her status as part of a written asylum procedure which was used in particular for asylum seekers from Syria and Iraq in the years 2015 and 2016. If she had an in-person interview ‘Anhörung’ as part of her asylum application, then if she is requested to go to a review interview, she can request BAMF in writing as to whether this is necessary.&lt;/p&gt;

&lt;p&gt;I cannot assess the chances of her status being revoked or maintained as I do not know enough about her situation.&lt;/p&gt;

&lt;p&gt;She can apply for permanent residency now. Generally a person needs to have been working for 5 years to be entitled to this. If she was not working for some of the last 5 years because she was looking after her children, then this is taken into account.&lt;/p&gt;

&lt;p&gt;She cannot apply for 25b as it only applies for people with the document ‘Duldung’.&lt;/p&gt;

&lt;p&gt;I recommend she applies for permanent residency and checks the letter from BAMF again to make sure that a specific reason for the review was not mentioned. It is open to her to seek legal advice or support from a migrant advice service to establish the grounds for the review. But based on your description of the situation, she has as of yet only been informed of the review process and isn’t under any obligation do to anything.&lt;/p&gt;

&lt;p&gt;At present you are not eligible for naturalization. For this you need five years of legal residency. There was until recently a possibility for faster naturalization after three years (commonly referred to as ‘Turbo-Einbürgerung’) but this has been removed from the law.&lt;/p&gt;

&lt;p&gt;The periods spent with the status of Aufenthaltsgestattung, Duldung and Ausbildungsduldung cannot be counted towards these five years as they are not considered full legal residency. The relevant basis for this is paragraph 10 of the naturalization law (Staatsangehörigkeitsgesetz). The first requirement listed there is that it applies to:&lt;/p&gt;

&lt;p&gt;“Foreigners who have been legally ordinarily resident in Germany for five years”&lt;/p&gt;

For permanent residency, the authorities can at their discretion include the time spent in the asylum procedure, even if the final decision was negative. For naturalization, the time in the asylum procedure is only counted if the person received full recognition as a refugee.&lt;/p&gt;

&lt;p&gt;In my view, you will fulfil the eligibility of five years of legal residence in Germany in December 2026. You may have not received your actual first legal permit until February 2022 but the decision was made in December 2021 and I would date your legal residency in Germany from that date.&lt;/p&gt;

&lt;p&gt;I have looked over the description of the Ausbildung and it seems to be a standard Altenpflegehelferin Ausbildung but with additional German lessons and a course on Staatsbürgerkunde (about German history, politics and society). This is why it takes two years instead of the usual one year for a standard Altenpflegehelferin Ausbildng.&lt;/p&gt;

&lt;p&gt;Because it is a Helfer-Ausbildung, there are additional requirements. It must be in a sector where Germany is in acute need of workers. The term in German for this is ‚Engpassberuf‘. Care work such as Altenpflegehelferin is such a profession where workers are needed.&lt;/p&gt;

&lt;p&gt;Your relative also requires an offer of a full Ausbildung place after doing the Helfer one. It is not possible to get an Ausbildungsduldung for a Helfer-Ausbildung unless there is the promise that the person can continue learning after it with a full Ausbildung. The most obvious Ausbildung to continue with would be as ‚Altenpflegerin‘ but there may be others in the healthcare sector that could suit. Your relative must therefore ask her employer to provide an offer for a subsequent Ausbildung providing she completes the Helfer-Ausbildung. This offer is called an ‚Ausbildungsplatzzusage‘.&lt;/p&gt;

I’m writing on behalf of a friend who has been living in Germany for six years under subsidiary protection. Today, she received a letter from BAMF informing her that her case is under review as part of the Widerrufs- / Rücknahmeverfahren (Revocation or Withdrawal Procedure).&lt;br /&gt;
However, the letter does not include a date or time for an interview, which has left her confused and concerned.&lt;br /&gt;
We would appreciate clarification on the following points:&lt;br /&gt;

1. Why would BAMF initiate a review after 6 years?&lt;br /&gt;
She has not committed any crimes.&lt;br /&gt;
She has never returned to her home country.&lt;br /&gt;
She has passed her B1 language exam and has started her own business in Germany.&lt;br /&gt;
She has a family, including two children—one of whom was born in Germany last year.&lt;br /&gt;
2. What could trigger this kind of review, and what should she expect during the process?&lt;br /&gt;
3. What are the chances of her protection status being revoked or maintained under such circumstances?&lt;br /&gt;
4. Is it necessary or recommended for her to consult with a lawyer immediately?&lt;br /&gt;
Any guidance you can provide would be greatly appreciated, as this situation is causing a great deal of stress and uncertainty.&lt;br /&gt;

&lt;p&gt;However, he can also not simply show up and disappear again if this is harmful to the child. In this case, the youth welfare office (&quot;Jugendamt&quot;) can provide advice or a court can make arrangements. &lt;p&gt;I do not understand what the person spoke with means by you ‚not having a right‘ to the residence permit 16g and that the immigration office has a ‚choice‘ to give it to you or not. It is important to know that 16g is a type of permit that must be issued if a person fulfils the requirements. You’ll see this if you **** at the German legal text of this paragraph in the immigration law (Aufenthaltsgesetz):&lt;/p&gt;

&lt;p&gt;It states that the permit ‚ist…zu erteilen‘. This means it must be given. There are other types of permits, where the law states they should (soll) be issued or can (kann) be issued.&lt;/p&gt;

&lt;p&gt;You either fulfil the requirements for 16g and must be given it or you do not fulfil the requirements and your application must be rejected. Unlike other types of permit, the immigration office does not have discretion (Ermessen) in such cases.&lt;/p&gt;

&lt;p&gt;Your identity was clarified (Identitätsklärung) after 6 months had already passed since making your asylum application. If it important to know that the six-month deadline does not necessarily require your identity to have been clarified in that time. It states that you must take all required and reasonable steps that are possible for you to do in that time. You cannot, for example, make contact with the authorities of your home country during the asylum process. It is not clear at what point in the timeline you first tried to obtain your birth certificate through your parents. If it was within 6 months of making your asylum application, the immigration office has to assess whether this was the only option available to you in this time to clarify your identity.&lt;/p&gt;

&lt;p&gt;I do not understand the suggestion of applying for 16a. Firstly, 16a is such a permit that ‚should‘ be given. Unlike 16g, it must not be given and the immigration office have more discretion to approve or not. You would also first have to leave the country and apply for a visa with the German embassy in your home country. As you mention the Ausbildungsduldung not being an option, if the application for 16g is rejected, then 16a is the only option left available. There is a special fast-track procedure for such applications at the German embassy called ‘beschleunigtes Fachkräfteverfahren’ but it will still take at least a couple of months.&lt;/p&gt;

&lt;p&gt;You can file a lawsuit of inactivity if an authority has not acted on your application after three months. It does not mean your case must be decided within three months. It means that there must be some kind of action on a case on their part within three months. If you wish to file such a lawsuit, you should speak with a lawyer. We can only provide a general assessment of your situation here and only a lawyer would be able to assess the likelihood of a potential lawsuit being successful or not.&lt;/p&gt;

&lt;p&gt;Is the organisation you spoke with willing to enquire with the immigration office on your behalf? If not, you yourself can write a letter to the immigration office which clearly states the timeline of events, and importantly detailing exactly what happened when with regard to identity clarification. If you have been doing well at your Ausbildung and have grades to prove this, you can send this also. Give them a deadline of two weeks to provide a response. You can mention that you have the option to file a lawsuit of inactivity if it has been more than three months without any action in your case.&lt;/p&gt;

&lt;p&gt;You say you are working for a large company. This company should have a HR department (in German ‚Personalabteilung‘) which is dedicated to handling employees’ needs. Another suggestion would be to ask this department to make a representation to the immigration office on your behalf. They can explain that you having a Duldung leaves both you and the company in a situation where every six months it is unclear whether you can continue the Ausbildung or not.&lt;/p&gt;

In this case, the old residence permit continues to exist with all legal consequences (e.g., access to the labor market, entitlement to social benefits) until a decision is made on the new application. In this case, too, there is an entitlement to a certificate of fiction.&lt;/p&gt;

The difference is that in the case of Section 81 (4) of the Residence Act, an existing residence permit is considered to be valid, which means that the entry requirement of possessing a valid residence permit is fulfilled. In the case of Section 81 (3) of the Residence Act, this is different because only the stay is considered to be permitted without a residence permit.&lt;/p&gt;

&lt;p&gt;From what you describe, the &lt;strong&gt;judge already gave a clear recommendation&lt;/strong&gt; to the &lt;em&gt;Ausländerbehörde&lt;/em&gt; (immigration office): to give you a &lt;strong&gt;residence permit under §25 AufenthG&lt;/strong&gt; (most likely §25 Abs. 5), since you are caring for your child while your wife is working, &lt;strong&gt;until&lt;/strong&gt; your wife’s citizenship renunciation process is finished.&lt;/p&gt;

&lt;p&gt;However, the &lt;em&gt;Ausländerbehörde&lt;/em&gt; (immigration office) sometimes does &lt;strong&gt;not immediately follow the court’s proposal&lt;/strong&gt;. The judge can give a strong recommendation or even a temporary ruling, but the final administrative decision is made by the &lt;em&gt;Ausländerbehörde&lt;/em&gt;. That’s why the judge gave them time (until April 7) to agree or disagree with the compromise.&lt;/p&gt;

&lt;p&gt;To your question:
&lt;br&gt; &lt;strong&gt;Yes&lt;/strong&gt;, the &lt;em&gt;Ausländerbehörde&lt;/em&gt; &lt;strong&gt;can still decide&lt;/strong&gt; to give you the residence permit under §25, if they agree with the court’s proposal.
&lt;br&gt; But they could also decide to give you a &lt;strong&gt;Duldung (temporary suspension of deportation)&lt;/strong&gt; until your wife’s renunciation is completed, if they prefer that option.&lt;/p&gt;

&lt;p&gt;The best thing you can do right now is to:&lt;/p&gt;

&lt;ol&gt;

&lt;li&gt;

&lt;p&gt;&lt;strong&gt;Stay in touch with your lawyer&lt;/strong&gt; and make sure they follow up before the April 7 deadline.&lt;/p&gt;&lt;/li&gt;

&lt;p&gt;&lt;strong&gt;Keep proof&lt;/strong&gt; that you live with your family and take care of your child (e.g. letters from employer, daycare, etc.).&lt;/p&gt;&lt;/li&gt;

&lt;p&gt;Be patient — if your wife’s renunciation is already in process, the chances are good that you will later receive the &lt;strong&gt;§28 residence permit&lt;/strong&gt; for family reasons.&lt;/p&gt;&lt;/li&gt;&lt;/ol&gt;

While they can send you another copy of the decision, this does not change the date it was delivered to you. If possible, you should get the original letter from the Asylheim. You should also check the second letter they are sending to see whether it is a copy of the initial one (in German ‚Zweitschrift‘).&lt;/p&gt;

&lt;p&gt;In the case of a standard asylum rejection, a person is given a deadline of 30 days to leave the country. After this point, the Ausländerbehörde can arrange for a deportation. Here is official information from BAMF:&lt;/p&gt;

In the worst case scenario, the authorities can say you never applied for anything after having your asylum case rejected and threaten you with deportation. Emails and phone calls you had in the past will not change this. If you need help writing an application, a migration advisory service in your area can assist you free of charge. However, I can’t confirm that changing comes without any risk. As you mentioned already, you need to apply for the respective permission from the Ausländerbehörde again and present the confirmation that you actually have a new offer for an Ausbildung already. In the meantime, your asylum appeal might get rejected which would complicate the situation (you might not be issued a Duldung etc.).&amp;nbsp;&lt;/p&gt;

Let me just break down my situation.&lt;br /&gt;
&lt;br /&gt;
I was an asylum seeker in south africa. &lt;br /&gt;
&lt;br /&gt;
moved to germany &amp;nbsp;with only my asylum seeker documents i received in south africa as those were my identification documents. Almost like an aufenthaltsgestattung but it has a scannable barcode.&lt;br /&gt;
&lt;br /&gt;
when i had my interview i provided the asylum documents because thats the only documents i had. i left my home country as an infant and as you know as an asylum seeker you can not seek documents like an ID or anything from your home country unless you are directed to do so by the immigration office. In south africa just like here, you can use the asylum seeker document to do anything and everything except for traveling outside the country.&lt;br /&gt;
&lt;br /&gt;
At the interview i was asked about if i have identification from my home country which i said no, ive never had which is true. ive only ever used the asylum documents considering ive never left the country. The interview happened, i was told that after the interview if ever i have any extra doocuments, i should bring it in.&lt;br /&gt;
&lt;br /&gt;
After a few months of leaving the Reception Center. I went to the Immigtation Office and ask them to explain my residence permit, what i can do and what i cant. thats when they told me my identity has not been cleared, even though when i **** on the screen i could see the asylum seeker document i have them. And they told me that its not a proof of identity. I was never told at my interview or anytime between that that my identiry has not been cleared. &lt;br /&gt;
&lt;br /&gt;
So i informed my parents about it and told them i need to clear my identity, i never had a id from my country because only i can do that. but my parents did their best and was able to get my birth certificate. which a month or 2 after the time i went to the immigration office i sent it to BAMF on the address i received after my interview when i was told &amp;quot;if i have any documents i should send to them&amp;quot;.. I was never given a response if it was received or not. Like nothing at all. I received a negative on my asylum application beginning of last year and when i went through the documents, i saw the birthcertificate copy inside with a stamp of when i sent it and everything. so it was only when i received the negative letter did i know that they received my birth certificate.&lt;br /&gt;
&lt;br /&gt;
obviously i did an appeal which was approve and i waited for a court date which never came. After speaking to a couple of Asylum Advisors. they told me about 16g which is when i thought of getting it.&lt;br /&gt;
&lt;br /&gt;
End of February i applied for 16g and since then ive been waiting for a response. im always reaching out to check how far it is and the response is always i should be patient till today.&lt;br /&gt;
&lt;br /&gt;
Just to be clear i was not hiding my identity, i thought it was cleared, soon as i found out it wasnt, i cleared it. &lt;br /&gt;
&lt;br /&gt;
And yes, the immigration office emailed me after i applied for 16g about this and i explained the exact same thing which they responded with okay.&lt;br /&gt;
&lt;br /&gt;
but till today im still waiting for an outcome to my application&lt;br /&gt;
&lt;br /&gt;
the reason i do not want to get an Ausbildungduldung: I am in tech, we have a lot of activities happening at school and at work. for example this year alone my school had 2 Auslands Programs which are fully funded for and i couldnt participate because i cant travel. My work has a workshop for all my colleagues in Austria and everyone went except me because i cant travel. both my sisters got married which i couldnt attend. there are a lot of women in tech events all over europe that i would like to attend but i cant with an ausbildungsduldung i will be restricted. so i dont want it. for each travel i kept in touch with the immigration office and they told me to be patient. They also advised me if i urgently need the residence permit i should leave the country voluntarily and apply for a visa and come back and thats the fastest way otherwise i have to wait cause everything takes long and they are very understaffed but thats a very uncertain situation and dont want to get stuck outside. so i decided against it.&lt;br /&gt;

&lt;br /&gt;
asylum case was closed December 2024 which i reached out to my country embassy and got an ID &lt;br /&gt;
&lt;br /&gt;
Provided the ID the embassy gave me to the immigration office January 2025&lt;br /&gt;
&lt;br /&gt;
Applied for Passport after getting duldung 60a and gave it to the immigration office February 2025.</description>

I know that Bosnia is non EU and for residence of EU countries can visit there for 90 days.. My daughter will stays for 5months with her Father in Bosnia and will get back in Germany before 6 months so she would not loose her residency. &lt;br&gt;I'm sorry to hear that your friend's asylum application was rejected again. But it sounds like there are some opportunities in the future. Either way, it will be important to get a passport. Why is it that he can't submit a passport? Has he really tried everything? In any case, it is important that he documents his efforts well and presents them to the relevant immigration authority (Ausländerbehörde).
&lt;br&gt;It is difficult to judge from a distance (without knowing too many details about the case). But here are a few thoughts on possible options:&lt;/p&gt;

&lt;p&gt;If your friend came to Germany before 31 October 2017, he may still be able to apply for the so-called &quot;Chancen-Aufenthaltsrecht&quot; by the end of 2025 (according to §104c AufenthG). However, one prerequisite would be that he also has a &quot;Duldung&quot; when he applies (has he already received this?). This residence permit according to §104c would also give him another 18 months to get a passport and then change to a residence permit according to §25a or §25b (you can also read the detailed requirements at &lt;span style=&quot;text-decoration: underline;&quot;&gt;&lt;a rel=&quot;nofollow&quot; href=&quot;https://handbookgermany.de/en/bleiberecht&quot;&gt;Handbook Germany&lt;/a&gt;&lt;/span&gt;).

&lt;br&gt;As you can see, his options depend on many factors. Every case is different and I would always recommend that your friend seeks support from a counselling centre.&lt;/p&gt;

I have looked into this question and have not found any specific law or administrative guideline where it states that both parents with shared custody must be present when submitting the application or when the child is granted German citizenship.&lt;/p&gt;

&lt;p&gt;The father will certainly have to co-sign the child’s application form for citizenship with you.&lt;/p&gt;

&lt;p&gt;If he cannot attend the immigration office in person, then he must in addition give his written consent to the Einbürgerung.&lt;/p&gt;

&lt;p&gt;The office in Berlin, for example, does not mention anything about the presence of both parents, only that the other parent with custody must provide their consent:&lt;/p&gt;

&lt;p&gt;„Für Kinder unter 16 Jahren mit gemeinsamen Sorgerecht der Eltern: Einverständniserklärung des anderen sorgeberechtigten Elternteils“&lt;/p&gt;

&lt;p&gt;They also provide a sample form (Muster: Einverständniserklärung des anderen Sorgeberechtigten) which the parent fills out, signs and submits with a copy of their signature as it appears on their ID:&lt;/p&gt;

This type of notarisation is called ‘offizielle Bglubigung’.&lt;/p&gt;

&lt;p&gt;There is another type called ‘amtliche Beglaubigung’ which can be done at the father’s local Bürgeramt/ Rathaus (the office for local administrative tasks such as doing an Anmeldung) if he lives in Germany. This is cheaper than going to a notary and in my view is also sufficient to present to a German authority in this case.&lt;/p&gt;

&lt;p&gt;There is no reason to apply for Alleinige Sorgerecht with regard to citizenship. It is not a requirement for citizenship, only the father’s consent is a requirement. How you decide on custody arrangements is a family matter and not something that an immigration officer should be pressuring you about. If the officer persists in this, request the legal basis (gesetzliche Grundlage) for it.&lt;/p&gt;

&lt;p&gt;She must first apply for a Duldung for herself and child, now that her case has fully ended. Once she has a Duldung, she mostly fulfils the requirements for 25b, as long as she has or does the 'Leben in Deutschland' test also. The requirement of financial security is not necessary if she is a single parent with a child under 3. If she is not a single parent, then it depends on the broader family financial situation. &lt;p&gt;The requirements for residence permit 25b differ slightly from many other types of residence permits. Usually a particular permit has requirements X, Y, and Z and they must all be fulfilled in order for it to be issued.&lt;/p&gt;

&lt;p&gt;25b is a permit that should be issued to a person with a Duldung who is considered to be 'sustainably integrated' (nachhaltig integriert). The legal text then goes on to state that such integration 'regularly requires' certain things, and then lists them. This means that generally a person has to fulfil all the requirements but exceptions can be made. An example would be if a person was heavily involved in their local community, volunteering with organisations etc. It is not enough that a person, for example, is a member of their local football club. They would have to be much more involved, like training the younger kids, organising competitions, attending meetings etc. over a longer period. Such engagement can be considered alternate proof of integration, meaning the authorities could accept it in place of the language requirement.&lt;/p&gt;

&lt;p&gt;In most cases, however, the language will be required. Please note it is spoken German that is required, not the overall level including reading and writing. A certificate confirming this level of German is not strictly necessary. The Ausländerbehörde can also accept that a person has fulfilled this requirement if the person can speak comfortably in German at this level with the Ausländerbehörde.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;Under certain circumstances the language requirement can be waived altogether. This is if it is not possible for the person to learn German to this level for reasons of illness, disability or old-age.&lt;/p&gt;

<description>Hi Friend, that’s a tough situation to be in. Trust me I was in the same situation last year but the other way round. The ausbildung authorities in my city was refusing to approve my ausbildung &amp;nbsp;stating it was too far etc. I fought them for 2 months alongside my advisor. They told me to apply for Umverteilung and if the ausländerbehörde in the new city approves, then they will approve my Ausbildung. The receiving authorities said I should provide them with a rental agreement and 3 months salary for my Ausbildung salary. And then they will consider my application again, they didn’t reject it, they just said it was incomplete. I had to go to my Ausländerbehörder every week to fight this because I told them how am I suppose to give them 3 months statement if I’m unable to move etc, it was just a constant back and forth. But my company ended up calling the receiving ausländerbehörde and they actually approved my move the same day. &lt;br /&gt;
&lt;br /&gt;
So maybe ask your company to do the same thing, tell them to reach out to the recieving authorities and explain to them that they need you etc and if your uncle can write a letter that you will be staying in his place for free, I think it will also help. But if you have to contact them yourself. Just tell them that you have applied everywhere in your surrounding area and have gotten only rejections and even cities around your city. All you keep getting is rejections. And that this is the only company that accepted you. &lt;br /&gt;
&lt;br /&gt;
If you will be able to take care of yourself, like secure your livelihood, reach out to them and tell them that aswell but they need proof. Probably **** for a minijob in the other city to increase your monthly income. So then you will have higher chances which is either Umverteilungsantrag Oder Antrag aufhebung der Wohnsitzauflage which means you are applying for the authorities to Remove the residence restrictions since you are Securing your own livelyhood and it will allow you to live in any City within your State. &lt;br /&gt;
&lt;br /&gt;
For Exemple my sister applied for Umverteilung and was Denied, but when she applied for the second one she got approved. Because she was in her own place, securing her own bills and literally not having any help from the government. But it’s different for her because she is doing ausbildumg in nursing and they receive a very high allowance. I don’t know how yours work but reach out to an advisor, they will tell you what to do. Everything I told you I did or the steps I told you to take were all the steps I was told to take by my advisor.&lt;br /&gt;

I don't think I have fully understood whether you have already been granted a &amp;nbsp;permanent settlement permit (Niederlassungserlaubnis) or have now applied for it for the first time. I did some research: EUR 67 is the usual amount for transferring a residence permit or permanent settlement permit to a new passport. The actual issuance is usually more expensive, if I understand correctly.&lt;br /&gt;
Is your title above ‘1-time transfer of settlement permit/permanent residence card’ the title of the invitation from the immigration office? This would indicate that a permanent settlement permit (Niederlassungserlaubnis) that has already been issued is merely being transferred and that the aim here is not to obtain a new title. Perhaps you would like to come back to us for clarification.&lt;br /&gt;
