What type of residence permit is issued for “Chancen Aufenthaltsrecht”?

Hello,

For people who qualify for the so called Chancen aufenthaltsrecht:

• What kind of residence permit is issued during the 18 month probationary period?
• What kind of residence permit is issue after the 18 month period given that all the requirements are fulfilled?

Welcome back to the Wefugees Community and thank you for your question. 

For the so-called "Chancen-Aufenthaltsrecht", people are issued a residence permit according to section 104c of the German Residence Act (it is a new section) for a period of 18 months (not only 12 months, as the former draft of the law described). While having the residence permit according to section 104c, people need to fulfill the requirements for either section 25a or 25b of the German Residence Act and switch accordingly. 

Please note that in the future applicants will be able to apply for the 25a until the age of 27 years.

@Meike do you mean that the chancen Aufenthalt doesn't lead to permanent permit? Secondly , have they approved it, will they be given the document now?

@Meike. If I understood it correctly then a successful candidate will be issued an Aufenthaltserlaubnis during and after the 18 months period, given that all requirements are satisfied.

@Nemo if it will lead to normal permit then i don't need it.. I will wait for my court date in regard to my german kids

Dear @felise and @Nemo, Exactly, the types of residence permits which are relevant in this context are temporary and not permanent (Niederlassungserlaubnis). However, after holding a temporary residence permit for a minimum of five years (and fulfilling the general requirements), you may be entitled to receive a permanent residence permit as well. @Meike thanks, that means I will wait for my court date in regard to my german kids , i think paragraph 28 is better than chancen Aufenthalt
