Hello dear team of wefugees,

I applied for asylum on 10th of August 2021 and people who applied on the same day with me already had their two interviews done and i am the only one left even though I am not Dublin and i have been living legally in Germany since 2018.

I really want to start German course asap and get work permit if possible, am I allowed to do these while being in a camp? And can I change my camp to move to another camp with a close friend of mine who is also living in a camp in the same region?

Btw i live near Flughafen Weeze Camp

Dear @Azimi

Welcome back to the Wefugees Community and thank you for reaching out to us again.

First of all, I am afraid that you need to be prepared for a longer waiting period regarding the interview etc. It is possible that your case at the BAMF is "on hold" for the time being. As far as I know, many asylum procedures of people from Afghanistan are currently not being processed due to the latest political developments in Afghanistan. I heard and read that the BAMF is wating for the German government to re-evaluate the situation in Afghanistan and for respective reports. Therefore, you can not necessarily compare your individual case with others and their schedule.

Regarding your questions on work: Wether you are already allowed to work is depending on the condition if you are still obliged to stay in a so-called reception centre (Erstaufnahmeeinrichtung) or not. As I am not familiar with the camp structures/types and the transfer procedures in your area, I would highly recommend you (as I also mentioned in your earlier opened threads) to consult a counselling office which will be much more familiar with the local settings. However, even if you are not obliged to live in a reception centre anymore - as long as you hold an Aufenthaltsgestattung (during the asylum procedure) you need to ask the immigration office (Ausländerbehörde) for the permission for a specific job. You will not get a general work permit. After you presented a job offer to the immigration office, they might contact the "Agentur für Arbeit" (which checks the working conditions etc.) as well. In case both offices approve the job offer, they will make a note in your Aufenthaltsgestattung mentioning the individual employer etc.

Regarding a camp change: I assume that "staying together with a friend" might not convince the authorities to give you a permission to move while waiting for the pending asylum procedure. But please discuss this also with a local counselling office.

I hope this helps and all the best,

Meike

Hello Mr Meike thank you for fast response.
The individuals who submitted their asylum case on the same day with me are also afghans that is why I am little worried they might put my case on hold because I was legally residing in Germany since 2018 hopefully I will get response from Bamf fast.

Should I hire a lawyer now or wait for my interview?
If you could provide me a link where i could contact English lawyers speaking in my region and also the social counseling in my area so I could consult with them over phone?

Best wishes
